Pimpinan Umno Gusar Berhadapan Dengan Rakyat Perak

Saya tidak terkejut dengan penghakiman Mahkamah Persekutuan pagi tadi yang mengisytiharkan Dato’ Seri Nizar bukannya Menteri Besar Perak yang sah. Umno sedang kuat mencengkam segala institusi agar memenuhi hasrat mereka untuk terus kekal berkuasa. Pimpinannya sanggup melenyapkan siapa dan apa sahaja yang menghalang mereka. Namun yang pasti mereka tidak berani berhadapan dengan rakyat.

Hanya mereka yang sudah usang dan sebati dengan kezaliman sahaja menyanggupi serta gembira dengan tindak tanduk kerajaan sekarang.

Kepada mereka yang mahu terus hidup mengabdi kepada kekuasaan, silakan, nikmatilah segala laba yang dihamburkan selagi masih berpeluang. Tunggulah saatnya nanti apabila laungan Rakyat Hakim Negara bergema menggegar bongkah-bongkah keangkuhan yang dibina dari darah dan air mata rakyat!

Saudara saya rakyat Malaysia sekalian, ini bukannya masa untuk berputus harap. Ini adalah waktunya kita menggembeling daya dan upaya kita untuk membawa Perubahan. Teruskan usaha membawa getar Perubahan ini di segenap pelusuk desa dan bandar. Tidak ada dolak dalih lagi, nyatakan dengan penuh keyakinan bahawa Perubahan ini demi kemaslahatan semua.

Anwar-The Victim of Overzealous Prosecution

I have been practising as a criminal lawyer for almost 16 years. I have considerable experience defending accused persons who were being charged for sexual related crimes. My experience tells me that the prosecution will never charge a person for an offence of rape or sodomy if the medical evidence is not favourable to them. It is almost an accepted rule of practice or a legal norm, as far as the offence of rape or sodomy is concerned, medical evidence operates as oxygen to the prosecution.

It seems to me that such a practice is no longer adhered to in the current ongoing trial of Anwar Ibrahim. When the accused person is Anwar Ibrahim the rule of game is suddenly and drastically changed. When Anwar is charged the prosecution no longer seems to gauge the strengths of its case on the available evidence they have. When Anwar Ibrahim is tried the prosecution will, come what may, happily proceed with the trial regardless whether it has fragile evidence or no evidence at all against him !!

The only crime Anwar committed in this case is for having the name, Anwar Ibrahim.

I believe that if another person by the name of Ibrahim Anwar or any other Ibrahims allegedly sodomised Saiful the prosecution would not charge such a person when provided with the medical report prepared by doctors in Pusat Rawatan Islam ( Pusrawi ) and Kuala Lumpur General Hospital respectively.

Both reports, as I was told by lawyers in Anwar’s legal team, contain a very damning evidence against the prosecution in that they unequivocally state that there are no visible signs of penetration of Saiful’s anus. As far as the report of the Kuala Lumpur General Hospital is concerned, it was duly signed by three doctors. So what the prosecution have in their possession are the reports certified by four doctors ( one from Pusrawi and three from KLGH ) apparently dismissing the prosecution’s theory that Saiful was ever sodomised by Anwar.

Why The Prosecution of Malaysia’s Anwar Ibrahim Matters to the West

IN THE PAST two years, Malaysia, which has been a one-party state since it gained independence in 1957, has made remarkable strides toward becoming a democracy. That it has done so is mostly due to the efforts and political talent of one man — Anwar Ibrahim. So the fact that Mr. Anwar went on criminal trial last week should deeply concern the democratic world. The outcome could determine whether one of Asia’s most economically successful countries preserves its stability and embraces long-overdue reforms.

A former deputy prime minister in the ruling party, Mr. Anwar was deposed and jailed in 1998 by former Malaysian strongman Mahathir Mohamad. A manifestly unfair trial followed in which Mr. Anwar was convicted of homosexual sodomy, which shamefully remains a crime in Malaysia. Six years later, the conviction was overturned by a court, and Mr. Anwar resumed his political career — this time as an open champion of democracy in Malaysia and other Muslim countries.

Mr. Anwar succeeded in forging a coalition of opposition parties, including his own multiracial People’s Justice Party, an Islamic party, and a secular party. He has campaigned against the government’s toxic policy of racial discrimination, which funnels economic favors to well-connected members of the ethnic Malay majority. In the past two years, his coalition has pulled off a string of stunning victories in state and parliamentary by-elections; it now controls four of 13 state governments. If led by Mr. Anwar, it would have a fair chance of winning the next national election in 2013.

That’s one reason it’s suspicious that, three months after the state election victories in 2008, Mr. Anwar was once again accused of sodomy. Another is that his young male accuser was seen with aides of Najib Razak, who is now prime minister; Mr. Anwar says he has evidence that the accuser met with the prime minister and his wife shortly before making his charge. A third is that the case has been transferred from criminal court to a higher court whose judges are closely linked to the ruling party.

If Mr. Anwar is convicted, he could be sentenced to up to 20 years in prison and would be banned from politics for five years. He is 62. The ruling party no doubt hopes a conviction will cause the opposition coalition to crumble. But it could just as easily provoke a backlash against Mr. Najib or street demonstrations that could destabilize the country. That’s why the Obama administration and other Western governments interested in stability in Asia should make clear that the imprisonment of Mr. Anwar would be a blatant human rights violation — and not in Malaysia’s interest.

The last time Malaysia’s former deputy prime minister Anwar Ibrahim was charged with sodomy, the country’s judicial system was on trial. This time around, the stakes are even higher.

If Anwar is convicted, in a case that opened in Kuala Lumpur’s High Court on Tuesday, Malaysians can wave goodbye to the best chance of developing a two-party political system in more than half a century.

It will also end any real prospect of Malaysia extricating itself from corrosive race-based politics, and signal the former British territory’s continued descent into self-destructive extremism.

Over the past two years, the charismatic Anwar, 62, has achieved what many analysts thought was impossible. He has tacked together three disparate political parties and formed a credible – if still fragile – opposition, representing hope for a multiracial future.

Nobody else has the organisational ability, political skills and personal trust to hold them together and provide the People’s Front, as it calls itself, with dynamic leadership.

Malaysian opposition leader Anwar Ibrahim has lost a last-ditch effort to have sodomy charges struck out of court.

Anwar alleges the charges brought against him are a political conspiracy and says the country’s prime minister, Najib Razak, was personally involved.

Mr Razak’s party has been in power for 50 years but Anwar has revitalised the opposition who polled well in last year’s elections.

Anwar’s lawyers attempted to have the case against him delayed on the grounds the defence had been denied access to crucial documents.

KUALA LUMPUR, Malaysia — The sodomy trial of the opposition leader Anwar Ibrahim finally began on Wednesday afternoon with a heavy police presence outside the Kuala Lumpur High Court and crowds of Mr. Anwar’s supporters cheering him on. There had been no shortage of drama at the court on Tuesday, on what was to have been the first day of Mr. Anwar’s trial on charges that he sodomized a former campaign worker. Mr. Anwar, a former deputy prime minister, said he planned to subpoena the incumbent prime minister of Malaysia, Najib Razak, and his wife.

Facing up to 20 years in prison if convicted, Mr. Anwar, 63, said he had evidence that his accuser, Saiful Bukhari Azlan, visited the prime minister and his wife shortly before he made the complaint in 2008.

“We have evidence that he was involved,” Mr. Anwar said, referring to the prime minister. “He met Saiful two days before the report was lodged to the police.”

The charges against Mr. Anwar were read to him in court at 3:34 p.m. on Wednesday, according to the Malaysia Star, which was live-blogging from the courtroom. The newspaper said Mr. Anwar responded that the charge was “malicious in intent.”

Malaysia’s Anwar Pleads Not Guilty To Sodomy Charge

KUALA LUMPUR (Reuters) – Malaysian opposition leader Anwar Ibrahim faced his 24-year old male accuser in court on Wednesday in a trial for sodomy that could see one of Asia’s best-known politicians jailed for 20 years.

The 62-year denies the charge, which he says is a plot to end his democratic challenge to a government which has ruled the Southeast Asian country for 52 years.

In a court packed with journalists, Anwar supporters and foreign diplomats, one of Anwar’s daughters shouted “repent” at former aide Saiful Bukhari Azlan as he entered the room.

Saiful identified Anwar as the person who had sodomised him in June 2008, saying the he had demanded sex in a condominium in uptown Kuala Lumpur.

“I was angry and afraid,” Saiful told the court.

“I rejected his offer. I said I didn’t want to do it,” he said as the court proceedings were brought to an end with the defence lawyers asking for the case to proceed in camera.

After Saiful’s comments, two of Anwar’s daughters reached to support their father while his wife put her arms around the daughters.

KUALA LUMPUR, Malaysia — A court trying Anwar Ibrahim for sodomy heard explicit details from his accuser Wednesday after the Malaysian opposition leader denied the charge that he had illicit sexual relations with a male aide.

At the start of the trial, Anwar claimed the allegation was part of a high-level conspiracy to thwart his political movement that came close to dislodging a government in power for more than five decades.

It is the second time in his political career that the former deputy premier has been charged with sodomy, which in Muslim-majority Malaysia is punishable by up to 20 years in prison.

He previously served six years in prison for alleged corruption and sodomy before the sodomy conviction was overturned. A new conviction could would be a huge setback to his opposition alliance, the only significant rival to the long-ruling government coalition.

KUALA LUMPUR, Malaysia — There may have been little progress inside the courtroom on Tuesday, but there was no shortage of drama outside on what was to have been the first day of the new sodomy trial of the opposition leader Anwar Ibrahim.

Fitnah Siri 2 Rencana Jahat Pemerintah

Pagi tadi bermulalah perbicaraan fitnah kali kedua ke atas saya. Mainan wayang yang sama diulang putar bertujuan mengelirukan rakyat dan menimbulkan kesangsian terhadap diri saya. Bahkan mereka sanggup memperalatkan sentimen agama demi kepentingan politik sempit. Mubahalah diulang-ulang walaupun ulama muktabar seperti Syeikh Yusuf al Qaradawi, Syeikh Wahbah Zuhaili dan mantan Mufti Wilayah Persekutuan, Datuk Hashim Yahaya menjelaskan ianya tidak selari dengan tuntutan Syariah. Sesuai dengan pendapat dari jumhur ulama, makanya saya menfailkan tuntutan qazaf ke atas pemfitnah saya. Buktikan fitnah ke atas diri saya sebagaimana yang gariskan oleh prinsip syariah! Jangan berani berdolak lagi serta cuba melengah-lengahkannya!

Berhadapan dengan makar yang direncanakan dengan penuh helah membabitkan keseluruhan jentera dan sistem kenegaraan, ternyata ianya bukanlah mudah, namun perjuangan menuntut Perubahan ini tidak akan sekali-kali mengendur. Cita-cita dan harapan kita bukanlah satu mimpi di siang hari. Kita mendambakan sebuah negara yang menjamin perlaksanaan Keadilan untuk semua. Bukannya sebuah negara yang hanya menyempurnakan nafsu jahat pemerintah semata-mata. Tidakkah pimpinan umno-bn sedar bahawa keyakinan rakyat terhadap sistem kehakiman dan pasukan polis semakin hari semakin luntur. Rakyat sudah mual dengan kehakiman dan pihak polis yang tunduk mengabdi kepada kehendak elit umno-bn.

Pun begitu saya tidak mempunyai pilihan lain selain dari berhadapan dengan fitnah tersebut di mahkamah. Barisan peguam yang terdiri dari Karpal Singh, Datuk Param Cumaraswamy, Sankara Nair dan Datuk Prabhakaran mahukan dakwaan ini digugurkan. Berasaskan peraturan serta proses perundangan, pelbagai permohonan diajukan, misalnya untuk mendapatkan bukti sesuai dengan kehendak peruntukan seksyen 51A Kanun Acara Jenayah. Apa kan daya, permohonan ini dihalang sistem kehakiman, sekaligus membenarkan saya “diserang hendap” oleh pihak pendakwa.

Adakah dengan segala perancangan yang direkayasa ini, mereka sangka saya akan berundur dari memperjuangkan agenda Perubahan demi kemaslahatan rakyat? Inshaallah dengan segala daya dan upaya serta diiringi doa semua, akan kita terus mara menewaskan kebejatan yang bermaharajalela.
