PETALING JAYA, Aug 18 — Abdurrahman Wahid, the former president of Indonesia and influential leader of Islamic group Nahdlatul Ulama, says Datuk Seri Anwar Ibrahim need not swear on the Quran as it is un-Islamic and there is no such requirement under Islamic laws.
Gus Dur, as he is popularly called, also said the recent swearing on the Quran by Anwar’s former aide Saiful Bukhari Azlan was un-Islamic. “I challenge anyone to prove the reverse. They better open the law books of Islam.”
Saiful has accused Anwar of sodomy and the de facto leader of PKR has been charged in court. Hearing is set for Sept 10.
“I think the accusation of sodomy is wrong. I have known him for 15 years. I believe totally in him,” Gus Dur said at a press conference at PKR headquarters here today.
He added that it was enough for Anwar to take the matter to the syariah courts and to say, “By God, I did not do such a thing.”
The PKR adviser had filed a complaint or qazaf in the syariah court last month against Saiful, charging him with making false allegations.
Gus Dur said that while his views were personal, they were shared by “many Indonesians” and the reason why other leaders had not spoken out was because of a “silent majority rule”.
Despite stepping down as president of Indonesia in 2001, Gus Dur is still the chairman and de facto leader of the Parti Kebangkitan Bangsa’s (PKB) syura council. PKB is the political arm of the highly influential Nahdlatul Ulama, an Islamic group that commands a following of over 30 million.
Gus Dur said that the former deputy prime minister’s chances of winning the Permatang Pauh by-election and becoming prime minister were “very good” and that he would be meeting Anwar on Sunday and again after the results of the by-election.
Meanwhile, he poured scorn on Prime Minister Datuk Seri Abdullah Ahmad Badawi’s execution of Islam Hadhari, saying that it lacked honesty and does not condone democracy.
“He acts in one way and says another,” Gus Dur said, adding that Anwar would make a more democratic leader.

WHY are Muslims so willing to swear on the Koran? Why can’t they go to the syariah Court and settle the matter? After all, if BOTH are Muslims and they hold Islam so strongly , why are they afraid to go to the syariah court?
As the former Indonesian President had mentioned, it is UN-islamic to swear on the Koran; and he has challenged anyone who thinks otherwise to quote the particular Islamic Law on oath-taking!
Now, the ball is in Badawi ‘s Court! Now, the ball is in Najib’s Court! Now, it is Saiful’s court ! PROVE to ALL Malaysians that it is proper to swear on the Koran!Even the Bible says that ” Do not take the Name of God in vain” ; which means that a Christian should not take God’s name lightly.

Prime Minister Abdullah Ahmad Badawi hit out at criticism of Mohamad Saiful after he was photographed last week at a city mosque, swearing on the Koran that he was telling the truth.

Just because someone swears on the Koran doesn’t mean that they are telling the truth.
I find this swearing nonsense dispicable.
If the law were entirely dependant on swearing on the Koran, why have a Court? Why not just dare the dependant to swear on the Koran? What gets discussed in nonsense I say.
The foundations of any court hearing is evidence. We must not forget this.

Since everyone is up to swearing and it’s like being a trend nowadays, I suggest that we get The PM, DPM, Ministers, civil servants, police, custom, immigration, JPJ, DBKL officers and who ever in the Government to swear on the Quran that:
1) THEY HAVE NEVER EVER BEFORE ACCEPTED BRIBES
2) THEY HAVE NOTHING TO DO WITH MONGOLIA
3) THEY NEVER GIVE CONTRACTS TO FRIENDS OR CRONIES OR SON IN LAW
4) THEY NEVER ACCEPT MONEY AT ROADBLOCKS, OR A CUSTOM INSPECTION CENTRE OR
IMMIGRATION CHECKPOINT ETC ETC
5) THEY HAVE BEEN LOYAL SPOUSES. NEVER HAVE FLINGS, NEVER HAVE AFFAIRS. ALWAYS LOYAL
6) THEY HAVE NO ROLE WHAT SO EVER IN THIS SODOMY ACCUSATIONS.

I had never ever ever ever seen in the entire universe about Sodomy act been discussed openly and without prudent of used of language. Now even a child of five years of age in Malaysia could utter the word SODOMY without any objection from parents.
It is pathetic that some Malaysians do look at Saiful as a hero and DSAi as the villain. What is so ‘news’ about sodomy? If it was an act of crime : A man cannot claim that he had been raped coz rape only applies to women. Then he should have reported under sexual assault or harassment.
The implication of what has occurred did challenge Malaysia Court of Justice – and unfortunately we have sleeping judges on the bench.
Hypothetical scenario:
If i rape a girl and before the girl lodge a police report, i went on reporting first saying that the girl actually asked for it. Then i go for sumpah laknat “Saya Mat CSI – Mengaku memasukkan zakar ke faraj perempuan so and so atas kerelaannya sendiri….perbuatan saya bukan merogol…tapi memberi apa yang dipinta oleh beliau….atas nama Allah….
Allah Huakbar! Hinanya Islam….Hinanya Mahkamah …Hinanya Masjid….Hinanya ALim Ulama…Hinanya Mufti…..Hinanya kerajaan!

Dalam kes ni, saya tak nampak yang mengangkat sumpah boleh memberikan sebarang masalah kepada DSAI jika benar dia di fitnah oleh Saiful Bukhari. Dengan menyahut cabaran sumpah oleh Saiful Bukhari juga akan memberikan sedikit keyakinan kepada pengikut n penyokong DSAI sekarang bahawa mereka menyokong orang yang betul. Bagi saya cara Saiful tu merupakan cara budak-budak yang ingin mengatakan apa yang dia lakukan tu betul walau ia salah…jd tak usah ikut cara budak-budak macam ni..apa tidaknya dengan menyebut nama Allah & Rasulnya dia boleh berbangga mengakui perkara yang mengaibkan terhadapnya depan orang ramai & di rumah Allah lagi tu….Hai apa dah jadi dengan Malaysia sekarang ni…. Buat kejahatan pun bangga ker??? kalau rasa orang tak caya, bersumpah di masjid dengan menghina Quran depan ramai…inikah namanya Islam?? Begitukah cara kita menyanjung Quran??? Dear Alls,
Saiful, as a Muslim should take the following steps.
1.If he was indeed sodomised (only he himself and the accused kwows), he should lodge a complaint or a report to the Syariah Court .
2.The Syariah Court would ask him to produce 4 REALIABLE WITNESSES (HUMAN OF COURSE).
3.Should SAIFUL failed to provide the witnesses, he would be warned by the Syariah Court that he would be comitting QAZAF – ACCUSING a person of comitting adultery or sodomy without providing the 4 reliable witness – he could be given 80 lashes on the back.
4.If Saiful is still with his allegation, he would be ask to swear in the Syariah Court.This swearing is arrange by the Syariah Court -NOT BY JAKIM OR POLICE OR HIS LAWYER.
5.During the swearing he had to say “WALLAHI,WABILLAHI,WATAALLAHI I ,SAIFUL TRUTHFULLY IS SODOMISE BY…….. ON 26 JUNE 2008. I AM PREPARED TO BE CURSED BY ALLAH SWT IF WHAT I AM SAYING NOW IS NOT TRUE.”
6.That is all.
DSAI need not to swear as he was the accused. Anyway DSAI should give his Alibi on that particular time and date. This should be given before the Syariah Court decided to proceed with the swearing.
Saiful would escape from be given 80 lashes by the Syariah Court BUT HE WOULD BE PUNISHED BY THE ACT OF GOD,SOONER OR LATER,IN THIS WORLD OR IN THE AFTER WORLD.

I understand the dilemma you are going through. However, we are dealing with an entirely unique situation that has divine effects and consequences.
There is absolutely no provision for the believers of all 3 Abrahamic religions (Judaism, Christianity and Islam) to swear on their respective holy books just to prove to others that they are telling the truth. This act of swearing is a custom that predates the coming of each religion and in the case of Islam, we can compare it with the jahiliyyah period. Thus, you will not find any such provision in the Torah, Bible or Quran, rather the act is strictly prohibited (Exodus 20:7) and (Matthew 5:34-37). Worse will be for anyone to swear with ulterior motives (for political gains or to please others) or to malign others, for that would certainly invite divine retribution.
DSAI has already filed a complaint with the Syariah Court in accordance with the provisions in Islamic law in an effort to seek justice and clear his name and dignity. We cannot expect him to do anything more than what is required by his religion. With all sincerity, DSAI is demonstrating that he is willing to risk losing his popularity rather than use his religion for political gains.

MS- SEBARKAN ( SOLAT HAJAT PERDANA DITUKAR TARIKH)
PERMATANG PAUH, 19 Ogos (Hrkh) – Program ‘Solat Hajat Perdana’ anjuran PAS Pulau Pinang ditunda tarikhnya daripada 21 Ogos ke 24 Ogos 2008 kata, Pesuruhjaya PAS Negeri, Ustaz Salleh Man pada Harakahdaily pagi tadi.
Mesyuarat semalam juga memutuskan ia terpaksa dibuat atas permintaan Menteri Besar Kelantan, Tuan Guru Dato’ Nik Aziz Nik Mat yang mempuyai program lain di Kelantan.
