Kenyataan Media Majlis Profesional Muslim

MPF regrets the unruly action of protestors that forced an abrupt end to the Bar Council forum on conversion to Islam on 9th August 2008. We acknowledge that as a nation with two justice systems as accorded by the Federal Constitution, there would be outstanding issues that remain unresolved, one of them being the subject of the Saturday forum.

It is quite understandable that when a divorce case between a Muslim and a non Muslim spouse is brought to the Syariah Court, the non Muslim would see this as an infringement of Islamic law against their rights. This may be due to a number of factors, among which are lack of knowledge and misconceptions of Islam and Islamic law based on precedent cases. It would not be inconceivable that there would be some degree of animosity and prejudice that the religion has directly or indirectly contributed to the dissolution of their marriage.

As much as we hold that the Syariah is an indivisible part of Islam, the functioning of the Syariah courts and the intricacies of specific enactments are human endeavours that will always have room for improvement.

The recommendation by a former SUHAKAM Commissioner, Dr. Mehrun Siraj that the Syariah court should not unilaterally make any decisions that might affect the rights of non Muslims, is a sound initiative towards resolving the issue and should be seriously considered by all states.

The Saturday incident, similar to the disruption of Article 11 Forum not long ago, showed that Islam and the administration of Islamic Law in this country is still very much a sensitive issue, one that touches many a Muslim across party lines. However, from the viewpoint of non Muslim rights on these outstanding issues and freedom of expression, there is a valid reason for holding such a public forum, with the possible consequences taken into consideration.

Meanwhile, we urge the government to reactivate the joint committee of civil and Syariah lawyers which had been tasked to discuss matters relating to marriage and family issues, to work towards an amicable solution.

MPF kesal dengan aksi tidak terkawal para pemprotes yang menyebabkan forum memeluk agama Islam yang dianjurkan oleh Majlis Peguam pada 9hb Ogos 2008 berakhir secara mendadak. Kami menyedari hakikat negara ini yang mempunyai dua sistem kehakiman sebagaimana yang diperuntukkan oleh Perlembagaan Persekutuan, semestinya ada isu yang masih tidak dapat diselesaikan, salah satu darinya adalah subjek forum pada hari Sabtu lepas.

Sesungguhnya dapat difahami bila timbul kes perceraian di antara muslim dan yang bukan Islam, kes tersebut akan diadili oleh mahkamah Syariah, makanya yang bukan Islam melihat adanya pelanggaran terhadap hak-hak mereka oleh undang-undang Islam. Ini mungkin disebabkan oleh beberapa faktor, antaranya kerana kurangnya pengetahuan dan salah faham terhadap Islam dan undang-undang Islam yang berasaskan rujukan kes terdahulu. Sememangnya dapat dibayangkan akan adanya ketidakpuasan hati dan prejudis bahawa agama ini telah secara langsung mahupun tidak menyumbang kepada pengakhiran perkahwinan mereka.

Kita yakin sesungguhnya Syariah itu sebahagian dari Islam, akan tetapi fungsi serta perjalanan mahkamah Syariah dan perincian enakmen yang spesifik adalah usaha insan biasa yang mempunyai ruang untuk dibaiki.

Rekomendasi oleh Dr. Mehrun Siraj bekas pesuruhjaya SUHAKAM agar mahkamah Syariah tidak secara bersendiri untuk membuat keputusan yang memberi kesan kepada hak bukan muslim, merupakan satu anjuran yang munasabah di dalam menyelesaikan isu ini dan wajar diberi pertimbangan oleh semua negeri.

Insiden pada Sabtu lepas mempunyai persamaan dengan insiden gangguan terhadap forum Artikel 11 tidak lama dulu, memperlihatkan Islam dan pentadbiran undang-undang Islam masih merupakan isu sensitif yang menyentuh Muslim melewati garis parti politik. Walau bagaimanapun dari sudut pandang hak bukan Islam berkenaan isu ini dan kebebasan berekspresi, ianya adalah munasabah untuk menganjurkan forum ini secara terbuka sementara mengambil kira kesan yang bakal timbul.

Sementara itu kami menggesa kerajaan untuk menghidupkan kembali jawatankuasa peguam sivil dan Syariah yang akan membincangkan hal-hal berkaitan dengan isu-isu perkahwinan dan keluarga serta berusaha untuk mencapai penyelesaian yang dipersetujui bersama.

    Orang Cina Malaysia:

    Both Christian and Muslim believe Adam Eve, Solomon(Sulaiman) David(Daud) etc. up to jesus.
    But Christian does not believe Muhammad as Prophet.

    Thats is the main different.

    I fully agreed with this press release..USA is a democratic country but thousands of americans are converted to Islam everyear! Thats means the more we open discussion and dialogue about Islam the more people are getting closer to Islam because Islam is the true relegion base on evidences and facts, and for sure islam will opens human mind and soul because of this! Even God asked prophet moses to have a talk with pharoah in a good manner. The non muslim action nowaday is just a reaction of what they saw about the “exclusiveness” of Islam in our country, they saw Islam is a thread to them, because trully they dont really know about this relegion. any action to put ISA involve in this problem will absolutely increase their wrong perseption to Islam. And we Muslim also do not really know about this issue and the worriness of the non muslims, it will makes ‘other hands’ playing this issue easily for their owned interest and benefit. So muslim should try to relax and try to understand this issue objectively and the non muslim should be more open to undertand Islam. p/s there are much more chinese and indian muslims in their own countries compare to malay muslims in our country.Islam is the fastest growing relegion in the west and on this earth but whats is wrong with malaysia?

    Christians believe in the Holy Book the Bible.
    One of the six (6) pillars of Faith (believe) in Islam is, believe in the acpocalyptic deliverence from Allah The AlMighty, to His Apostles, through the four Holy Books.
    The first Holy Book to Mankind is the Taurah - Prophet Musa.
    The second is the Zabur - Prophet Daud.
    The third is the Bible - Prophet Isa.
    And the fourth and Final Revelations is contained in the Holy Quran, the continuation of the Holy Teachings from Allah The AlMighty to mankind, thro’ Prophet Muhammad s.a.w, the last Prophet from Allah (Peace be Upon the Prophet Muhammad)and the Hadith (Practices and Sayings), was delivered to the Muslims from and during the lifetime of Prophet Muhammad s.a.w (Peace be Upon the Prophet Muhammad), and is preserved by Allah The AlMighty until Doomsday, to be continually practised by Muslims i.e. the Holy Quran and The practices from the Hadith i.e. Sunnah Rasulullah.
    The six (6) pillars of Faith are :-
    i) Faith in Allah,
    ii) Faith in Allah’s Holy four (4) Books,
    iii) Faith in the Angels,
    iv) Faith in the Prophets of Allah,
    v) Faith in Doomsday, and
    vi) Faith in the Destiny of Allah, as determined by Allah The AlMighty (Faith in the Qadar’ and Qadar from Allah The AlMighty).

    i) I witness that there is no other God to pray to except to Allah, and I witness that Muhammad was the Prophet of Allah,
    ii) Pray five (5) times a day,
    iii) Fast in the month of Ramadhan,
    iv) Pay tithes (Zakat) and
    v) Perform Hajj, (at Mecca, if affordable)
    PERKIM (established during the time of the late 1st Prime Minister of Malaysia, Tunku Abdul Rahman), with offices in every state in Malaysia, can be contacted for more details, there have qualified personnel to convey further the above.
    There are already numerous Chinese, Indians, Kadazans, Ibans, Orang Asli and other races and ethnic groups in Malaysia, who have been conveyed the Islamic Teachings, and are now practising Muslims.

    So where is the Bar Council Malaysiakini and the Zulkifpli Nordin bashers? Where are these champions of Freedom of Expression which after so long continue to criminalize and demonise MP Nordin?
    Justice Tee Ah Sing, handed Datuk Muhammad Shafee Abdullah every bit of protection Anwar Ibrahim was for so long and are still being denied. His Wife Wan Aziza, their children his friends colleagues and even the opposition to some extent.

    Where have the good learn judge been all the while. In Trinidad we would say: outa no where, whey he come from?

    Does this send a warning as to the direction in which DSAI case is heading- Datuk Muhammad Shafee Abdullah got everything even an entire blogs data which means he will be gunning for every body in Malaysia-in fact readers might as well get scared.

    What you Malaysians need to do now is haul a thousand lawyers up to the HC to represent this journalist/blogger and frustrate Datuk Muhammad Shafee Abdullah Gestapo tactics which he should have left to the Mosad or the Third Reich.

    The Gestapo gets the privilege “right” too ID, pursue before he can sue. Ask for the privilege information; the Mosad will have a field day.

    As it is for some time a decade or so; this nation of spice skin ladies and gentle men doesn’t reflect the beauty of Baitk silk and candle oils perfumed in the Malayu aroma that separate a kaleidoscope of colours that renders Black & white and not Black campo white which churns a dull reflection of gray and not gay skies where the sun no longer shines.

    Batik reflects the essence of an independent justice system where the candle-oil keeps flamboyance “Money and justice and the judiciary from the executive”, whatever and whoever may have trusted its processes. Batik mind you is a more appropriate symbol and less complicated than the KERIS as the former signify respect and unity and when don is a beauty to behold.

    Back to my fears:
    It will be interesting to see or hear any citizen offered this degree of protection which mind you not even the Agong(s) throughout the past 27 years have.

    Well it seems, not even a habeas corpus could guaranty any thing in this country - So I Thank God I am free.

    Apabila sahabat Nabi mengembara ke Negara China dan menyebarkan Islam di sana orang2 China di sana dapat menyebarkan Islam secara meluas ke negara mereka hingga penganut Islam disana berkembang melebihi penduduk Malaysia sendiri. Mereka menghargai Islam yang diwariskan kepada mereka.

    Di Malaysia pedagang2 Arab menyebarkan Islam dan mewariskannya kepada bangsa Melayu untuk mengembangkan Islam. Tetapi sebaliknya berlaku. Orang Melayu gagal untuk menyebarkan Islam. Penduduk bukan Islam di Malaysia tak tahu kebaikan Islam kerana kita orang Melayu tak menunjukkan contoh yang baik. Hari2 kat surat kabar cerita pasal orang melayu buang bayi, hisap dadah dan macam2 lagi.

    Dalam satu hari berapa kali kita cerita pasal Islam pada org bukan islam.

    I have to say that I got no right to talk about Islam and its teachings as I’m a non-Muslim because don’t know deep in the religion. But i have respect to all the religions in the world even Islam as they they are the national religion of Malaysia. In accordance to it we must understand people, the Bar Council did not hold forum to Ban Islam in Malaysia, all they wanted to talk about is the ‘conversion to Islam’ . As a true Muslim, they should have accepted this issue in a professional way and prepare to debate the truth rather than turning it into a racial slur. The way I see it, Malaysians are heading the wrong way in believing their own religion. An open minded and professional community is the root for a developed nation. I see our Malaysian people, turn everything into racial discrimination if their practice of Islam is mentioned even for the good of its own people. This post is truthfully not to hurt nor discriminate any Muslims and their religion, as I’m just pointing out my opinion to share with. Thank you.

    Assalamualaikum Datuk Seri/ moderator/ administrator,

    I have just received a rather shocking and disturbing sms information regarding the above from a student leader at UiTM that reads like this :

    ” Esok pagi 15hb jam 8-11 pg, pelajar UiTM akan buat demonstrasi pasal kenyataan Tan Sri Khalid… akan berarak sekitar Pmtg Pauh…bagi saya ini sesuatu yang bodoh..dulu mrsm n matrikulasi siapa yang masukkan cina n india…lani baru nak bersuara pertahankan melayu…hrp PKR dapat follow….Tq ”

    I am very uncomfortable with this and it surely looks like BN/ UMNO are behind this latest fiasco. Would be appreciative if you could look into this urgent issue ASAP.

    Islam bermakna sejahtera. Ia adalah agama yang membawa kesejahteraan pada kesemua umat manusia samada yang beragama Islam mahupun yang menganut agama-agama lain seperti Kristian, Yahudi, Buddha, Hindu, Bahai dan lain-lain. Islam memperakui nabi-nabi dan rasul-rasul terdahulu sebelum Nabi Muhammad S.A.W. dan telah menjadi salah satu Rukun Iman bagi umat Islam untuk beriman dan percaya kepada nabi-nabi dan rasul-rasul berkenaan. Dalam kontek ini, kesemua umat Islam wajib beriman dengan Nabi Isa, Nabi Musa, Nabi Ibrahim, Nabi Daud, Nabi Yusuf dan seterusnya sehingga kepada Nabi Adam dan Hawa. Islam melarang umatnya menghina penganut-penganut agama lain dan Islam juga menghormati upacara-upacara keagamaan penganut-penganut agama ini. Punca kekeliruan bukannya disebabkan Islam itu tidak lengkap, tetapi perlaksanaan perundangan Islam di negara Malaysia ini amat longgar yang menyebabkan perselisihan & kekeliruan berlaku. Memang ada ‘gap’ di antara perundangan sivil & syariah yang perlu dicari jalan penyelesaian, namun pemimpin-pemimpin kerajaan tidak mahu berusaha untuk ke arah ini dan akibatnya kekeliruan masyarakat terhadap perundangan Islam bertambah kusut. Pemimpin-pemimpin yang bersikap ‘racial’ akan sentiasa menggunakan isu ini sebagai jalan keluar untuk menarik sokongan masyarakat melayu Islam apabila tahap populariti mereka dipenghujung ‘tanduk’. Penggunaan media arus perdana untuk memainkan dan menghangatkan isu ini akan berterusan supaya pemimpin-pemimpin rakus ini dapat memegang terus tampuk pemerintahan. Akhirnya, ‘gap’ perundangan sivil dan syariah akan masih menjadi isu yang tiada penghujungnya. Selama 50 tahun memerintah, tiada jalan penyelesaian ke atas konflik perundangan sivil dan syariah. Apakah kita akan menunggu sehingga 50 tahun lagi? Kita perlukan satu reformasi perundangan bagi mencapai satu titik pertemuan untuk kedua-dua perundangan sivil & syariah. Dengan adanya penyesuaian dan kesepadanan ke atas ‘gap’ ini, tidak mustahil bagi masyarakat Malaysia untuk menerima perundangan syariah sebagai satu alternatif penyelesaian apabila berlaku krisis kekeluargaan yang melibatkan ahli keluarga beragama Islam dalam keluarga bukan Islam. Jika ini berlaku, ianya merupakan satu rahmat kepada rakyat Malaysia umumnya….

    We human beings make mistakes and sometimes it takes someone in the crowd to openly declare that, ‘THE KING IS NOT WEARING ANY CLOTHES.’ Now we have among us a group that are aware and some who are still not aware. Those who are not aware of the, ‘TIME BOMB.’ in our midst are being used by unscrupulous human beings for their own greedy and selfish ends. The world is changing fast and even countries like conservative China realises that she cannot survive or compete globally if she sticks to her age old practices, traditional beliefs, customs and they are even trying to learn foreign languages to keep up with the more developed nations. The problem in Malaysia are not just going to affect Malays and Muslims alone, it is also going to affect non Malays and non Muslims and even foreigners. Our economy, social and political stability and everything else following it will ultimately become mammoth issues which the govt of the day may not be able to tackle. DSAI is an astute politician unlike his other counterparts and predecessors. He is learning from their mistakes, not only from his very own experiences. He is getting the support from the crowd not because the crowd has suddenly fallen for PR and its magic. PR is trying its best to create a political platform with its ideology based on the latest trend towards development. As much as we want to retain our age old beliefs, traditions, customs etc…. we still have to be a part of GLOBALISATION. We cannot run away from this fact of all facts!!!! I say all this with the greatest sadness because as Malaysians of the various races each of us wish to keep and guard our traditions, beliefs and faith, but this may not be the practise in the near future.

    I believe the purpose for bar council holding such forum is to seek an amicable solutions toward the conversion of islam, but not their intention to insult islam etc. But those protestor (Islam extremist) are behaving rudely and without thinking just go to protest. These extremist are the people that should be lockup and re-educated about ISLAM. Mosque or surau should also play their part by letting every muslim know that such actions is not welcome by their gods.

    Isu UiTM ni jangan dilayan sangat,ini mainan untuk mengisi menu harian akhbar UMNO.Terbaru,saya dapat info UMNO/BN akan hantar pesuruh upahan untuk memenuhi Permatang Pauh.Hotel penginapan,makan minum free,duit upah lagi RM 200 keatas,jadi DSAI amabil berat tentang pesuruh dan pengundi upahan ini,
    Satu lagi hal dalaman PR pun kena tengok,apahal PAS dah ada puak satu yang mahu JV dengan UMNO dan ada yang Klik Anwarism,cth Tuan Guru Nik Aziz dah beritahu ada dalang dalam PR(merujuk pada PAS)yang nak sabotaj DSAI jadi PM,pls beware my next PM of Malaysia.Diharap apabila DSAI jadi PM berikan rakyat keselesaan hidup seperti:
    1)Turun harga minyak seminima mungkin
    2)Bangunkan kereta,kenderaan dan stesen NGV dgn harga berpatutan
    3)Air percuma
    4)Electric murah
    5)Internet jalur lebar murah seminima mungkin exp TM Net
    6)Sekolah percuma, termasuk sekolah KAFA(Agama)
    7)Hospital ,perubatan dan klinikal kes percuma di hospital kerajaan
    8)Hapuskan atau kurangkan tol dan bayarannya.Jalan baru tanpa Tol.
    9)Pendidikan tinggi kerajaan percuma(Uni,Kolej etc)
    10)Tambah pelaburan dan lonjakkan peluang kerja(swasta dan kerajaan)
    11)Rumah harga patut,selesa
    12)Polis jaga keselamatan awam, kurang jenayah,letak pondok dan anggota di setiap taman Perumahan.Polis rasuah atau kianat bagi diorang jaga Zoo.
    13)Masjid tempat info untuk orang islam, bukan ramai ramai ke kedai TOTO,ekor.Sebarkan peranan masjid dlm TV.
    14)Transform TV1,2,3,Utusan Msia, badan kerajaan dsb kearah lebih bertakwa

    Wake up people, we are now living in 21st century not in stone age. Stop this uncivilized / barbaric method to voice out your unhappiness.

    No wonder people with brain or money are migrating out of Malaysia. If this doesn’t change, Malaysia will become 3rd world country soon.
