Is it wise to use the Whistleblower Protection Act and the Witness Protection Act to protect the ‘Datuk T’ trio who released a sex video involving a man said to resemble an opposition leader?

This is what will be done if the authorities feel they have a case, Minister in the Prime Minister’s Department Mohamed Nazri Abdul Aziz (left) had told reporters in the lobby of Parliament House yesterday.

The ‘Datuk T’ trio are businessman Shazryl Eskay Abdullah, former Malacca Chief Minister Rahim Tamby Chik and Perkasa treasurer Shuib Lazim.

Malaysiakini called several top criminal lawyers for their opinion on whether the position taken by the de facto law minister would be proper use of the two laws.

Lawyer Baljit Singh Sidhu (right), who authored the book ‘Criminal Litigation Process’, said it would be “a misfit” to protect the three under both laws.

“Such provisions are used to protect a person who informs (the authorities) about a crime. However, there are questions about the agenda of the three, whether there is malice involved (in revealing the sex video),” he said.

“The other question is whether they truly want protection. The way they presented themselves in showing the tape is as if they do not need any protection. One of them is a former chief minister and they appeared rather gung ho in showing it.”
He said the act of showing the video to the public is in itself an offence.

Whistleblower law cannot include ‘dirty politics’

Another lawyer, Amer Hamzah Arshad, asked whether what the trio disclosed was a criminal act that requires protection, such as affecting the security of the nation, a major corruption scandal or a scandal involving a huge corporation.

“It is merely about two consenting adults having sex. It is not illegal from a legal perspective but (is) a question of morality. However, it may have problems under Syariah law,” he noted.

“Whistleblower or witness protection laws should be used on a person who leaks information about an organisation or crime committed by someone. The whistleblower law is aimed at protecting the informant of a crime committed, and is not about an immoral act,” Amer (left) said.

Furthermore, he said, this law should not be stretched to cover “dirty politics”.

“If you have information on a crime being committed, you should approach the authorities. You do not go out in public to call the press. You go to the police station and then you seek protection. They did not go to the police first and instead they screened the video.”

‘They revealed their identities’

Johor-based lawyer, Hisyam Teh Poh Teik, said that, in the first place the ‘Datuk T’ trio had revealed their identities voluntarily.

“Since they have not complained about concerns over their safety and they have exhibited the video with great fanfare, they must be responsible for their actions,” said Teh, a former Johor Bar committee chairperson.

“What they have done doesn’t make sense (to require witness protection). They were proud to show the video and it is illogical now for them to ask for protection or for the authorities to (provide it to them).”

Baljit reiterated that despite what was being said, Opposition Leader Anwar Ibrahim, who is accused of being the person in the sex video, should be answerable.

“He should tell the truth and the authorities themselves should work so that the truth of the whole affair is determined,” he said.

The video was shown to selected members of the press at the posh Carcosa Seri Negara hotel on March 21. The man in the footage – recorded on Feb 21 – was said to closely resemble Anwar.

Anwar has denied any involvement.

The ‘Datuk T’ trio of Eskay, Rahim and Shuib revealed their identities two days later, on March 23.

Both Eskay and Rahim had their statements recorded by police last Thursday night while Shuib, who was picked up in Sungai Petani, had his statement taken at Bukit Aman the next day.

PENYIASATAN KES VIDEO LUCAH DAN KESUDAHANNYA :-

MAKLUMAT HUBUNGAN LAMPAU DIANTARA TIGA TAN SRI IAITU, GHANI PATAIL , MUSA HASSAN DAN RAHIM THAMBI CHIK.

Semoga Tan Sri tenang dan tabah menangani cabaran mendatang.

2. Saya percaya Tan Sri sedar video lucah mana yang saya maksudkan.Saya yakin sepenuhnya bahawa PDRM mampu menjalankan tanggung jawabnya menjalankan siasatan tersebut secara professional dan berkecuali dan tidak terpengaruh dengan tekanan mana-mana pihak sekalipun, lebih-lebih lagi dibawah pimpinan Tan Sri ketika ini.

2.1. Namun begitu kertas siasatan ini kelak akan diteliti dan diputuskan olih Gani Patail,Peguam Negara.Diperingkat inilah dijangka akan berlaku,putar belit,manipulasi,penipuan dan pemalsuan apabila sedar akan caramana Gani Patail dan Musa Hassan menangani penyiasatan kes-kes jenayah apabila melibatkan Anwar Ibrahim(Anwar) dan Rahim Thambi Chik (Rahim) dimasa lampau.

2.2. Tidak syak lagi isu video ini adalah satu lagi “pertembungan” diantara Anwar dan Rahim.Adalah dipercayai juga motif pendedahannya,tidak kira samada video tersebut adalah tulen atau direkacipta,adalah terbit daripada dendam lama Rahim terhadap Anwar atas isu peribadi atau politik diantara mereka berdua.

LAPORAN POLIS ANWAR YANG MEMBABITKAN RAHIM.

3. Diantara 9 July 1999 hingga 20 Ogos 1999,Anwar telah membuat sejumlah empat(4) laporan Polis, mendedahkan perbuatan rasuah pemimpin-pemimpin Politik dan Kerajaan.Dalam laporan-laporan berkenaan Anwar turut mendakwa dan menamakan mantan Perdana Menteri Tun Mahathir,Peguam Negara Allahyarham Mohtar Abdullah dan Gani Patail,ketika itu DPP Kanan,sebagai orang-orang yang telah menyalahgunakan kuasa dan menutup kes-kes rasuah tersebut.

3.1. Pertembungan lampau antara Rahim dan Anwar adalah apabila salah satu diantara laporan tersebut iaitu Tun H.S.Lee report 22517/99 bertarikh 20.8.1999 yang dibuat olih Anwar melibatkan Rahim.Dalam laporan ini Anwar juga mendakwa Tun Mahathir,Allahyarham Mohtar dan Gani Patail sebagai telah menyalahgunakan kuasa mereka melindungi perbuatan rasuah Rahim serta menutup siasatan dan tidak mengenakan sebarang pendakwaan terhadap beliau.

3.2. Bersekali dengan report tersebut, Anwar telah menyertakan satu set salinan laporan siasatan Badan Pencegah Rasuah(BPR)terhadap Rahim yang disahkan oleh Bahagian Pendakwaan,Jabatan Peguam Negara dan ditanda tangani oleh Gani Patail yang mengkelaskan dokumen tersebut sebagai RAHSIA.Dokumen-dokumen ini dikatakan diberi kepada Anwar oleh Peguam Negara dan/atau Gani Patail ketika Anwar masih Timbalan Perdana Menteri.

4. Untuk makluman Tan Sri,secara kebetulan, saya yang menangani keempat-empat laporan yang Anwar buat itu termasuk laporan melibatkan Rahim atas sifat saya sebagai Ketua Jabatan Sisasatan Jenayah(KJSJ) Kuala Lumpur ketika itu.Saya perhatikan juga amaun rasuah melibatkan Rahim adalah antara yang paling sedikit jika dibandingkan dengan laporan-laporan lain.Jumlah terlibat lebih kurang RM40 juta(Empat puloh juta Ringgit sahaja) atau angka yang lebih tepat ialah RM 39,782,772.60 sen. Amaun ini dikatakan diperolehi olih Rahim menerusi salahguna kuasa dan kegiatan rasuah setakat yang dapat dikesan menerusi siasatan terperinci BPR dan disahkan olih Gani Patail. (more…)

Malaysia’s dirty politics reached a nadir last week when the local media reported on a new video featuring a man who looked like former deputy prime minister Datuk Seri Anwar Ibrahim having sex with a prostitute in a hotel room.

Coming at a time when Anwar is battling sodomy charges in court, it makes you wonder just really how low can it go.

The video was shown to a few journalists from the mainstream media who were selected and screened in a fashion worthy of a cloak-and-dagger novel.

The government-controlled media, which have played a key role in previous campaigns to discredit Anwar, violated every known ethical practice of journalism by providing graphic reports of the alleged “sex sojourn” without verifying the identities of the video’s subjects.

Typically, the source of the video was not disclosed, evoking the popular Indonesian (and Malay) saying lempar batu sembunyi tangan, which means “throw the rock, hide your hand”. No one took responsibility for screening the video, but the mainstream media played along and reported what their journalists saw.

Ever willing accomplices, the media broke one of the credos of journalism: Identify your sources, especially when making allegations as serious as this.

The Malaysian media did not bother to identify the man in the video. The mere suggestion that man looked like Anwar Ibrahim was enough to cast doubt on Anwar’s credibility and integrity in the supposedly puritan yet hypocritical society. Truth and verification go out window when you are part of a propaganda machine.

The media placed the onus on Anwar to disprove the claim, something which would likely keep him busy for the next several months or even years, certainly until the next general election.

We have seen this before when Anwar was first sentenced to prison for sodomy, only to have the Supreme Court to overturn his conviction in 2004.

Subsequently, new sodomy charges appeared and Anwar has been busy going to and from the courtroom.

Sex, media and video conspiracies define Malaysian politics today. It gets dirtier all the time.

Solidariti Mahasiswa Malaysia (SMM) akan melancarkan kempen ‘Rakyat Selamatkan Malaysia yang akan berlangsung selama dua minggu bermula 28 Mac hingga 8 April ini bagi membantah amalan politik lucah dan kotor yang semakin membimbangkan.

Menurut pengerusinya, Ahmad Syukri Ab Razab, SMM meletakkan sasaran untuk mengadakan perhimpunan besar-besaran dengan tema “Himpunan Rakyat untuk Politik Bersih Dan Adil pada kemuncak kempen tersebut.

Dua ulama terkemuka dunia bersedia menjadi saksi bagi membela Datuk Seri Anwar Ibrahim mengenai isu pluralisme.

Sebelum ini, Menteri di Jabatan Perdana Menteri, Datuk Jamil Khir Baharom berkata kerajaan sedang menyiasat ucapan Anwar di London School of Economics tahun lepas kerana didakwa kononnya mempromosi pluralisme.

Menurut Anwar, nampak jelas Jamil tidak memahami maksud pluralisme dan tidak membaca ucapan beliau.

“Pluralisme bukan bermakna kita menghina atau merendahkan kekuatan Islam.

Sebaliknya ia adalah fahaman yang mempromosi toleransi dan berbaik-baik antara agama dalam dunia,” kata beliau.

Menjawab satu soalan Anwar berkata sekiranya kerajaan ingin mendakwa beliau ke Mahkamah Syariah, itu hak mereka. “Dua ulama terkemuka dunia Yusuf al-Qaradawi dan Dr. Sheikh Taha Jabir al-Alwani sudah menyatakan kesedian menjadi saksi sekiranya kerajaan mendakwa saya di Mahkamah Syariah,” tambah Anwar.

Tindakan Jamil menyiasat Anwar menyerlahkan hipokrasi kerajaan BN kerana sebelum ini Jamil juga menghalang pelaksanaan qazaf dalam kes melibatkan dakwaan Saiful Bukhari Azlan terhadap Anwar.

The Malaysian Consultative Council for Buddhism, Christianity, Hinduism, Sikism and Taoism (MCCBCHST) has described the recent emergence of a sex video as slander designed to humiliate Anwar Ibrahim.

In a statement signed by president Reverend Thomas Philips, the council urged the government to take swift action against ‘Datuk T’, the code-name used by three individuals who have admitted to being behind the release of the video. (more…)

Pertama, mereka mahu tahu mengapa hakim tidak memberi amaran keras kepada polis sewaktu menyampaikan keputusan pertama dalam bicara-dalam-perbicaraan dahulu.

Tiga buah kereta polis mengelilingi rumah Timbalan Presiden PKR Azmin Ali, untuk menyerah satu notis yang meminta agar beliau melaporkan diri di balai polis untuk diambil keterangan pada 28 Mac.

Satu kenyataan dikeluarkan Biro Komunikasi PKR pada tengah malam tadi, memaklumkan media bahawa rumah kediaman Azmin Ali (gambar kanan) sedang dikelilingi polis. Bagaimanapun, berita ini dikesahkan kemudian bahawa tindakan polis tadi adalah untuk menyerah satu notis kepada Azmin Ali, agar beliau melaporkan diri di balai polis pada hari keesokan (28 Mac 2011).
