PKR leader Anwar Ibrahim is set to question the Kuala Lumpur Syariah Court on its “intentional delay” in hearing his action against former aide Mohd Saiful Bukhari Azlan for qazaf (false accusation) which was filed two years ago.

In this regard, Anwar will file an application at the court tomorrow morning.

He will also sign the wakalah which is a legal agreement allowing him to be represented by a syarie lawyer.

Anwar had filed the suit on July 2008 to urge the court to order the Federal Territory (FT) Syariah public prosecutor to prosecute Saiful for qazaf under Section 41 of the Syariah Criminal Offences Act (Federal Territories) 1997 and/or syariah laws.

He named FT Syariah public prosecutor Shamsuddin Hussain, FT religious department head Che Mat Che Ali and minister in charge of religious affairs Jamil Khir Baharom as respondents. (more…)

(Plainfield, IN – January 4, 2010) The Islamic Society of North America (ISNA) commends the landmark ruling by a Malaysian Court on December 31, 2009, that affirms the religious freedom of Malaysian Christians. The ruling asserts that Christians have the right to use the word “Allah” to translate “God” into Bahasa Melayu, the Malaysian language. It strikes down a government ban that was placed in 2007 on the use of the term in Christian literature.

The opponents of the use of the word Allah in reference to God have argued that the term “God” is usually translated by Malaysians who follow faiths other than Islam as “Tuhan” in Bahasa Melayu, not “Allah.” They insist that “Allah” should only be used to refer to God in Islam. This argument is contrary to both Islamic understanding and practice.

The Qur’an is quite explicit that Muslims worship the same God recognized by Christians. The Qur’an commands Muslims to declare that the God they worship and the one worshiped by the followers of revealed books, including Christians, is one: “… and say: We believe in that which has been revealed to us and revealed to you, and our God and your God is One, and to Him do we submit.” (Qur’an 29:46)

With regards to actual and historical practices, Christian Arabs have been using the word “Allah” to refer to God in their religious sources since the inception of Islam, and have never been challenged by private Muslims or Muslim governments on this ground. Islamic law is clear that followers of the Christian faith have the right to practice their religion according to their own religious teachings.

We call on the Malaysian government to uphold the religious freedom of Christians and to let the court ruling stand. We also urge Muslim NGOs to respect Islamic teachings and long-held Islamic traditions, and to withdraw their opposition to the use of the word “Allah” by their Christian compatriots.

Jet engines: ‘We need a better story, AG’

‘Rather than prosecuting the rank-and-file that managed to pull of this brilliant smuggle, we should promote them to be the heads of our security agencies.’

Freemsia: Let me get this whole story right – low-ranking officers were able to sneak out two huge RM50 million jet engines without getting detected by army security and without any authorisation from top officers and then proceed to contact a foreign buyer in Uruguay, have the engines sent out without raising suspicions from our Customs Department.

Then get paid millions after selling the engines, deposited the money into their accounts without being known by Bank Negara? Or maybe they deposited the money in a Swiss bank account?

If the government actually decided to sell this story to Hollywood, the movie would flop. Somebody get a better storyteller for the government to spin something more realistic.

Mangodurian: Rather than prosecuting the rank-and-file ‘ikan bilis’ that managed to pull of this brilliant feat of smuggling, we should promote them to be the heads of security agencies and the armed forces.

Without any help, they managed to find a buyer, steal the engines from the repair shop, smuggle them out of the air force facility, pack and ship them out of the country, arrange for payment through a proxy and keep it under wraps for two years.

This is much harder than smuggling cash or a few gold bars. I say, promote these brilliant dudes!

Steven KC Poh: Does the attorney-general think the rakyat is dumb enough to believe that there were no higher-ups involved? He wants us to believe that the rank-and-file were powerful enough to escape the eyes of the air force, the Customs Department and what not?

This AG has to be sacked immediately. Please. Next time, at least come out with a better story. (more…)

Kelihatan polemik berhubung nama Allah dibenarkan penggunaannya oleh Herald lewat penghakiman Datuk Lau Bee Lan dalam kamar Mahkamah Tinggi (Bahagian Rayuan dan Kuasa-kuasa Khas) beberapa hari lepas telah semakin meleret-leret ke satu tahap yang adakalanya mendukacitakan, dan tidak kurang memualkan.

Ada pihak yang menyatakan sebagai Muslim, saya tidak boleh berkecuali, mesti pilih setuju atau menentang. Ya,dalam bab mempertahankan agama saya akan menyokong, tetapi menggunakan agama untuk kepentingan tertentu, sudah pasti saya menentang sehabisnya.

Sebagai orang tidak mempunyai latar belakang dalam bidang agama, maka saya lebih senang untuk melihat sesuatu isu itu melalui pelbagai perspektif, baik dari aspek agama sendiri, aspek sejarah, aspek perlembagaan dan aspek rasionaliti. (more…)

–Kenyataan Akhbar–

Merujuk kepada kenyataan kami pada 22 November 2009 mengenai perkara di atas, maka BIPPA PKR sekali lagi ingin menjelaskan pendirian kami mengenai hal ini.

Kami berpendirian bahawa, keinginan masyarakat bukan Islam menggunakan kalimah “Allah” sebagai Tuhan adalah suatu perkembangan yang positif dan perlu diterima secara terbuka dan tidak perlu pihak-pihak tertentu mengambil kesempatan untuk menjadikan isu ini sebagai agenda politik untuk menampakkan bahawa merekalah jaguh dalam mempertahankan Islam di negara ini.

Sesungguhnya, kami melihat fenomena ini adalah manifestasi dari fitrah insani bahawa manusia memperakui penciptaan dunia oleh Allah SWT sebagaimana firmannya yang bermaksud:

“Dan jika kamu tanya mereka (orang kafir) siapakah yang mencipta langit dan bumi? Mereka akan berkata Allah…” (Al Quran, Az-Zumar (39):38).

Adalah jelas bahawa penggunaan kalimah Allah untuk mengiktiraf dan membesarkan Allah sebagai Tuhan, adalah hak asasi setiap insan. Ini adalah serasi dengan peruntukan dalam Perlembagaan Persekutuan Perkara 3 (1) yang menjamin kedudukan Islam sebagai agama rasmi Persekutuan dan lain-lain agama boleh diamalkan dengan aman dan damai. Sesungguhnya, ini juga bersesuaian dengan muafakat Pakatan Rakyat yang diputuskan baru-baru ini.

Selanjutnya, kami berpandangan perjuangan untuk menegak makruf dan mencegah mungkar akan menjadi lebih mudah dan selesa berasaskan firman Allah:

“Katakan wahai Ahli Kitab, mari tegakkan kalimah yang sama antara kami dan kamu iaitu bahawa kita tidak akan menyembah selain Allah dan tidak mensyirikkan (associate) Allah dengan satu apapun serta janganlah ada antara kita yang mengambil tuhan-tuhan selain Allah. Dan jika mereka berpaling maka katakanlah bahawasanya kami adalah orang Islam (menyerah diri pada Allah)” (Surah Ali `Imran(3):64).

Sehubungan itu, demi menjaga keharmonian dan kesejahteraan negara semua pihak perlulah menyelesaikan konflik ini dengan menyuburkan budaya dialog antara agama secara matang dan bijaksana (hikmah) sebagaimana saranan Allah mengenainya (Al Nahl: 125 dan Al Ankabut:46).

After a special meeting to discuss a recent controversial court ruling, PAS has decided to reiterate its stand that the use of the word Allah by Christians was not against Islam and in accordance with the federal constitution which guarantees religious freedom.

“As a responsible Islamic body, PAS is ready to explain this issue to all parties in order to ensure a harmonious environment that is based on the principles of fairness such as is guaranteed in the constitution and by Islam itself,” PAS president Abdul Hadi Awang said in a statement issued after a three-hour long discussion.

He also called on all parties not to politicise the matter as this could threaten the peace among the different religious groups in the country. (more…)

Pakatan Rakyat mencurigai kenyataan awal Peguam Negara Abdul Gani Patail berhubung kes kecurian enjin pesawat F-5E milik Tentera Udara Diraja Malaysia.

Ahli Parlimen Sungai Petani Johari Abdul berkata kerajaan seharusnya menjelaskan bagaimana kehilangan aset ini dari inventori TUDM gagal dikesan Ketua Audit Negara.

Ketua Audit Negara melaksanakan audit keatas kementerian dan agensi kerajaan setiap tahun dan di bentangkan di Parlimen untuk dibahaskan. (more…)

Barely two months after the launching of the Malaysia Makkal Sakti Party (MMSP), its president RS Thanentiran is facing ouster following a split in ranks.

Secretary-general R Kannan today confirmed that the party’s 27-member central committee (CC) would be booting out the founder president at a meeting slated to be held this Saturday.

“The party’s CC has agreed to dismiss him for tarnishing the party’s good name,” he said when contacted. (more…)

Tinjauan Detik Selangor, buletin harian hanya di TVSelangor.com, siaran secara langsung TV sesawang maya ini, mendapati rungutan ramai kalangan rakyat bahawa mereka terus dibeban dengan kenaikan harga barang pengguna, khususnya kenaikan harga gula sejumlah 20 sen sekilo, berkuatkuasa semalam.

Rakyat dibebankan kenaikan harga gula dari RM1.45sen sekilo kepada RM1.65sen di Semenanjung dan RM1.75sen di Sabah dan Sarawak.

Bendahari Agung FOMCA Mohd Yusof Abdul Rahman mengingatkan rentetan kenaikan lain-lain barangan pengguna akibat dari keputusan kerajaan Barisan Nasional menaikkan harga gula ini. (more…)

Walaupun berdepan dengan pelbagai tekanan dan penarikan diri ahli panel, namum forum membantah e-undi dalam pilihanraya kampus, tetap diteruskan walaupun terpaksa diadakan di koridor dewan kuliah utama Akademi Pengajian Islam (API) Universi Malaya (UM) malam tadi.

Forum yang membahaskan tajuk “E-Voting dan Masa Depan Demokrasi Mahasiswa” dikejutkan penarikan diri pensyarah terkenal Dr Abdul Aziz Bari (kiri) sebagai ahli panel beberapa jam sebelum majlis itu berlangsung.

Forum anjuran Gabungan Mahasiswa Bantah E-Undi (BANTAH) itu terpaksa diadakan di luar dewan tersebut selepas pihak pentadbiran membatalkan penggunaan dewan kuliah untuk forum tersebut, tiga hari lalu. (more…)

Secara ringkasnya, apabila merayu ke Mahkamah Persekutuan, di dalam kes jenayah, rekod rayuan akan disediakan oleh mahkamah rayuan, dan ianya mesti diserahkan kepada perayu. Selepas sahaja diserahkan rekod rayuan tersebut, perayu mestilah memfailkan petisyen rayuan dalam masa 10 hari dari tarikh penyerahan rekod rayuan oleh mahkamah. Selepas petisyen rayuan diserahkan, barulah tarikh pendengaran rayuan boleh ditetapkan oleh mahkamah persekutuan.

Pada 6-11-2009 Mahkamah rayuan telah membenarkan rayuan oleh Pendakwa Raya di dalam hal berkenaan seksyen 51A Kanun Prosedur Jenayah. Datuk Seri Anwar Ibrahim telah pada 17-11-2009 memfailkan rayuan kepada Mahkamah Persekutuan terhadap rayuan tersebut.

Melalui transmisi faks bertarikh 29-12-2009, pihak kami telah dimaklumkan oleh Pendaftar Mahkamah Persekutuan bahawa rayuan oleh DSAI tersebut telah ditetapkan untuk Bicara pada 6-1-2010. Di dalam surat yang sama, pihak kami telah diarahkan untuk memfailkan Petisyen Rayuan dengan kadar yang segera. Pihak kami merasa terkejut kerana Rekod Rayuan masih belum diserahkan kepada kami semasa surat pemberitahuan tarikh bicara tersebut diterima oleh kami.

Pada 30-12-2009, pihak kami telah menerima surat bertarikh 23-12-2009 melalui perkhidmatan pos laju, yang menyerahkan kepada kami rekod Rayuan dan Rekod Rayuan Tambahan.

Melalui Kaedah 95 (1) kaedah-kaedah Mahkamah Persekutuan 1995, pihak kami dikehendaki untuk memfailkan Petisyen rayuan dalam masa 10 hari dari tarikh penyerahan Rekod Rayuan.

Jelas, Petisyen rayuan mesti difailkan sebelum atau pada 9-1-2010 yang mana jatuh pada hari sabtu dan disebabkan itu mesti difailkan pada 11-1-2010.

Oleh itu, adalah mustahil untuk Bicara rayuan tersebut untuk dijalankan pada 6-1-2010.

Pihak kami menyatakan di sini bahawa prosedur yang telah dijalankan oleh mahkamah ini adalah salah dan tidak adil kepada pihak perayu.

PRESS STATEMENT

In relation to the section 51A Criminal Procedure Code documents, the Court of Appeal allowed the appeal of the Public Prosecutor on 6.11.2009 following which on 17.11.2009, Datuk Seri Anwar Ibrahim appealed to the Federal Court against that decision.

By fax transmission dated 29.12.2009, my firm was informed by the Registry of the Federal Court that the Federal Court had fixed the date of hearing of the appeal on 6.1.2010. In the same letter of notification, my firm was also asked to file the Petition of Appeal on an urgent basis. My firm was taken aback by this development because the Record of Appeal had yet to be served on us as at the date of notification of the hearing.

On 30.12.2009, my firm received a letter dated 23.12.2009 through poslaju, serving on my firm the Record of Appeal and the Additional Record of Appeal.
By Rule 95(1) of the Rules of the Federal Court 1995, my firm is required to file a Petition of Appeal within a period of ten days after service of the Record of Appeal.

Clearly, in the circumstances, the Petition of Appeal is required to be filed by 9.1.2010. The 9.1.2010, which being a Saturday and therefore a holiday, with Sunday being an intervening holiday, my firm is required to file the Petition of Appeal by 11.1.2010.

It is impossible under the circumstances for the hearing of the appeal to proceed on the 6.1.2010.

In any event, Mr. S. N. Nair of our firm who is the solicitor in charge, left for India on 28.12.2009 and is only due to return in the late evening of 5.1.2010.

The procedure adopted in relation to the matter herein is certainly unprecedented and does not, and cannot, serve the end of justice.
