Kunjungan ke Jakarta
Kelmarin, sebaik selesai menghadiri sesi Dewan Rakyat, saya berlepas ke Jakarta bagi memenuhi undangan sahabat lama, Goenawan Mohamad – pendiri Komunitas Salihara yang menjemput saya menyampaikan pidato falsafah berjudul “Kebebasan & Musuh-Musuhnya” sempena Festival Salihara Ke-3.
Selain mengupas tema kebebasan dari perspektif peribadi, saya turut menekankan peri pentingnya tuntutan terhadap kebebasan yang harus didukung atas prinsip moral dan keyakinan rohani.
Pada sebelah pagi semalam pula, saya diwawancara secara langsung oleh TVOne Indonesia dan antara lain mengulas soal kebebasan serta sekatan media, hubungan antara Malaysia-Indonesia dan juga isu-isu yang melibatkan Tenaga Kerja Indonesia (TKI) di Malaysia. Sebelumnya saya bersarapan dengan sahabat lama, Mas Adi Sasono, Rachmat Ismail dan Sugiarto. Kami ngobrol panjang mengenai kerjasama ekonomi dan budaya serantau yang nyata sekali mengesankan.
Saya seterusnya memenuhi undangan bersama Bapak Din Syamsuddin, Ketua Umum Muhammadiyyah Indonesia yang turut disertai oleh wakil-wakil organisasi Islam di sini. Antara yang diputuskan termasuklah usaha meningkatkan kerjasama serta memperbaiki hubungan Malaysia-Indonesia. Turut serta dalam perjumpaan tersebut ialah Setiausaha Agung Nahdatul Ulama’, Wakil Ketua Dewan Daawah Islamiyah Indonesia dan Ketua Dewan Masjid Indonesia.
Kemudian saya bersama-sama dengan YB Azmin Ali, YB Datuk Kamaruddin Jaafar (MP PAS – Tumpat) dan YB Dr. Xavier ke Dewan Perwakilan Rakyat bagi memenuhi perjumpaan dengan Wakil Ketua dan Ahli Parlimen Komisi Luar Negara dan Pertahanan. Persetujuan dicapai agar kerjasama dua hala dipertingkat di kalangan Ahli-ahli Parlimen kedua belah negara.
Saya hargai keprihatinan mereka yang turut menuntut agar fitnah yang dilemparkan kepada saya dibawa dan diadili menurut lunas-lunas Syari’ah.

Jawapan bertulis daripada Kementerian Pertahanan berhubung pembangunan semula pangkalan udara Sungai Besi di Kuala Lumpur di Dewan Rakyat hari ini menimbulkan lebih banyak persoalan daripada jawapan berhubung projek kontroversial itu.
Menurut kementerian pertahanan, kerajaan pada dasarnya telah menerima cadangan daripada 1Malaysia Development Bhd (1MDB), yang lembaga penasihatnya dipengerusikan oleh Perdana Menteri, Datuk Seri Najib Razak yang juga adalah menterti kewangan.
Bagaimanapun, tidak ada surat menyatakan hasrat atau letter of intent (LOI) dikeluarkan, kata Menteri Pertahanan, Datuk Seri Ahmad Zahid Hamidi dalam jawapan bertulisnya kepada Tian Chua (PKR-Batu).

Musa Hassan and Gani Patail were accused today as being the cause of the destruction of the criminal justice system by having allowed falsified evidence against Anwar Ibrahim in 1998 and later lying about an investigation of Mahathir Mohamad for abuse of power.
In an open letter published at Malaysia Today, former Kuala Lumpur CID chief Mat Zain Ismail disclosed that he had written in May this year to Ismail Omar, then deputy IGP, and to Hishammuddin Tun Hussein, the home minister, for a review of the investigation into false evidence produced against Anwar in the “black eye” case of 1998.
(Mat Zain headed the investigation into the case and recommended that the Inspector-General then, Rahim Noor, be tried for criminal assault on Anwar Ibrahim in the lockup at police headquarters. Rahim was found guilty and sentenced to two months’ jail.)
He said Musa and Gani had claimed in press reports that investigation papers on the Mahathir case had been sent to the Attorney-General in February 2000 and the AG (the late Mohtar Abdullah) had decided that there was no case.
Mat Zain said the statements were absurd. The investigation papers in the Mahathir abuse of power case were only opened in June 2000 and sent to the AG’s Chambers in November that year.
Questions raised in Shafee Yahya bookIn his letter dated 8 October, Mat Zain accuses Musa, recently-retired as Inspector-General of Police, and Gani, the Attorney-General, of lying about the Mahathir investigation.
Mahathir, then prime minister, had been accused of abuse of power by ordering a halt to corruption investigations against Ali Abul Hassan bin Sulaiman, head of the Economic Planning Unit, during which RM1000,000 in cash was found in his office.
Mat Zain made these revelations in a letter to Datin Kalsom Taib, wife and biographer of Shafee Yahya, former head of the Anti-Corruption Agency, in response to questions asked in her book of her husband’s life and career.
She had asked: “What happened to the probe on Dr Mahathir?”
Mat Zain quoted from the book, which referred to press statements by Musa and Gani about the investigation:
“The IGP confirmed that an investigation on Dr.Mahathir was carried out. (NST 9 April 2008)
“Our recods show we had submitted the investigation papers to the AG Chambers on 15 February 2000. The decision made by the AG at that time (the late Tan Sri Mohtar Abdullah) was that there was no case.”
In The Star of the same date (9 April 2008), it was reported that Tan Sri Abdul Gani Patail confirmed,
“The Chambers received the investigation papers from the police sometime in February 2000 and after studying it carefully, found no evidence to suggest that Dr. Mahathir had interfered in the investigations”
Mat Zain said the statements by the two men did not make any sense and were false.
It is impossible for the investigation papers to be sent to the Attorney General’s Chambers on 15 February 2000.
Gani Patail and Musa Hassan: they destroyed the criminal justice system, says Mat Zain
“The investigation papers were only opened on June 13, 2000 based on a police report made by Anwar Ibrahim on that date.
“In fact, the investigation papers together with ACA investigation papers seized from the agency were only sent to the Attorney General on 9 November 2000.”
Mat Zain suggested that maybe the IGP and AG meant the 15th of February 2001.
However, even if Musa Hassan and Gani had said 15 February 2001, it would be even more unreasonable.
Tan Sri Mohtar Abdullah could not have examined and dismissed the case on that date as he was not longer the Attorney General.
He had been succeeded by Datuk Ainum Mohammad Said on January 1, 2001.
Mat Zain suggested that Musa Hassan and Gani Patail had not bothered to amend the date because the person named, Tan Sri Mohtar Abdullah, had since died. “The dead cannot speak. Maybe they forgot that many of those still alive who know these things and can question the fact.”
“If Tan Sri Musa Hassan and Tan Sri Gani Patail did not make the absurd statement that this case will not be sustainable. The fact is they who have opened the flood-gates for more questions to be raised about the integrity of the police investigation.”
They both have undermine police investigation in this case, as well as having allowed falsified evidence in the Anwar Ibrahim “black eye” case when Anwar was beaten up in the Bukit Aman lockup by Rahim Noor (righta), then the Inspector-General.
Mat Zain decided to retire from the police force in 2001. He has since been embroiled in suits involving the several Anwar Ibrahim cases, and has also alleged that he is being victimised by the police force.

Tindak tanduk kerajaan Malaysia kian merisaukan, sikap acuh tidak acuh kerajaan dalam bertanggungjawab terhadap pelbagai masalah dalam negara amat membimbangkan rakyat. Mungkin kerajaan lupa bahawa warga negara yang layak mengundi terdiri daripada jutaan rakyat yang berakal dan
memerhati mereka setiap hari dan bukan hanya penyokong tegar Barisan Nasional atau Pakatan Rakyat.
Rencana kali ini cuba mengupas kembali beberapa peristiwa yang masih menjadi tanda soal dalam benak pemikiran rakyat jelata. Rencana ini berpandangan mengenai persepsi rakyat yang sudah mula khuatir dengan corak pimpinan yang kian tidak masuk akal, langsung tidak bermotifkan politik seperti cuaca yang melanda Negara sejak 2008.
Teoh Beng Hock
Kita petik dahulu peristiwa kematian mendiang Teoh Beng Hock. Daripada apa yang diketahui umum, Teoh Beng Hock telah dipanggil ke ibu pejabat Suruhanjaya Pencegahan Rasuah Malaysia di Shah Alam. Mendiang telah disiasat selepas waktu pejabat selama sembilan jam sebelum ditemui mati pada jam 1.30 petang. SPRM menyatakan bahawa mendiang kali terakhir ditemui masih hidup sekitar jam 6.00 pagi, dan menyatakan bahawa mendiang telah dibebaskan pada jam 3.45 pagi namun tiada penjelasan
diberikan mengapa telefon bimbit dan barangan milik mendiang masih dalam simpanan SPRM sewaktu mendiang ditemui mati. SPRM juga menjelaskan bahawa mendiang telah memohon untuk bermalam di pejabat tersebut.

Kalau diteliti, usia paling berpotensi seorang pemuda adalah usia antara 20 sehingga 30 tahun, maka mahasiswa adalah elemen terpenting dari golongan ini. Mahasiswa ini berada pada posisi yang sangat menguntungkan. Baik dari segi usia (masa pencapaian potensi maksima) mahupun dari segi
lingkungannya yang berupa lingkungan akademis. Kemampatan emosi yang ditunjangi dengan intelektual yang cukup akan menghasilkan sebuah idealisme. Idealisme yang dihasilkan ini umumnya masih fitrah, dengan erti kata idealisme itu dibangunkan atas dasar keinginan untuk mewujudkan suatu sistem yang bersih dan adil. Bukan idealisme yang telah dikotori oleh najis kekuasaan, kekayaan atau kepentingan lainnya.
Itulah sebabnya kebanyakkan pergolakan atau penentangan kepada penguasa bermula dari kampus. Orang-orang yang sedang memiliki “idealisme fitrah” itu kalau dihadapkan pada sebuah ketidakadilan atau sesuatu yang tak sesuai dengan idealisme itu, maka timbullah jiwa yang memberontak. Dengan demikian muncullah gerakan-gerakan menentang penguasa yang digerakkan oleh mahasiswa. Disitulah terlihatnya kehebatan gerakan ini. Pemerintah atau
penguasa sebenarnya tidak begitu selesa dengan situasi ini, sehingga terkadang gerakan ini harus dihentikan dengan keras, ugutan dan tidak terlepas yang dikenakan undang-undang zalim terhadap mereka iaitu Akta Universiti dan Kolej Universiti 1971 (Auku).

Majlis Peguam Malaysia menegaskan adalah satu kesalahan jenayah untuk mana-mana individu menukar akuan bersumpah yang dibuat secara sukarela.
Presidennya Ragunath Kesavan mengulas tindakan bekas pembantu kepada Datuk Seri Anwar Ibrahim, Rahimi Osman, yang semalam menukar kenyataan bersumpahnya dua tahun yang mengaitkan Perdana Menteri Datuk Seri Najib Razak dan isteri, Rosmah Mansor, kepada tuduhan fitnah liwat yang dihadapi oleh Datuk Seri Anwar Ibrahim.

Ertinya beliau mohon dan diterima sebagai anggota KEADILAN semasa beliau masih menjadi ahli MCA, tanpa memaklum hal ini. Ini satu kesilapan.
Lebih serius, Dr Lee telah dipilih tanpa bertanding sebagai Ketua Cabang Bukit Bintang.
Biro Politik KEADILAN telah membincang kes Dr Lee ini. Kami akan membuat keputusan tentangnya setelah mendapat perakuan dari Jawatankuasa Pemilihan Parti (JPP) dan Sekretariat.

Press Statement
In response to the allegation of duress by Rahimi Osman

I wish to strongly state that at no point in time had I ever used any form of duress or undue influence on Rahimi Osman in relation to the statutory declarations that he signed.
At all the material times, I was among several lawyers assigned to prepare witness statements from several potential witnesses, which is a norm in any legal defense. In my several meetings with Rahimi, I was accompanied by another lawyer, Radzlan Jalaluddin to interview him at the party headquarters at Tropicana. We prepared statutory declarations for some of the witnesses including Rahimi which is normal practice and for the protection of the witness as well.
These statutory declarations were prepared because in certain cases (as in the present case), there were possibilities that witnesses for whatever reasons may decide to change their testimonies and therefore these statutory declarations can be used as a form of defence against such potential turn around. For example, in the previous cases against DSAI, a few persons connected to DSAI were wrongfully taken away by the police and were subjected to various forms of torture and abuse, and eventually they were made to “confess” and testified against DSAI. See the cases of Sukma Darmawan, Dr Munawar Anees and Meor. In such cases, these statutory declarations can further be used as a form of protection for the witnesses themselves in the event of such wrongful incidents.
Rahimi’s allegation that the statutory declarations were amended to include the names of Dato Seri Najib Razak and Datin Seri Rosmah Mansor without his consent is completely untrue and without any credibility at all. This is because in his own statement given to the police at IPK on 23.7.2008 in the afternoon, he has confirmed that he knew that Saiful had met Najib and Rosmah. He also told the police that he himself was taken by Mumtaz Jaafar, a close friend of Rosmah to meet her and also Najib. Rahimi shared this information with us after his interview with the police. He also told the police about his meeting with Ezam Md Noor and SAC Rodwan.
Further these individuals’ involvements in the case were confirmed by Saiful Bukhari’s testimony in court. Ezam Md Noor and Mumtaz Jaafar were called in for identification by Saiful. Najib has also admitted to the press that he has met Saiful when he came to his house.
The allegation that we confined him in Quality Hotel is ludicrous and totally untrue. He was there on his own free will at all times and volunteering information to assist us with DSAI’s case.
These statutory declarations that he voluntarily signed were just part of the several meetings with him over the course of some months as he was also called to clarify or assist on factual matters within his knowledge during the pre trial preparations.
At all the material times, he had voluntarily cooperated and met up with the lawyers whenever he was asked to assist. Even though he was no longer officially employed at the office of DSAI, he has however continued to come over to the party headquarters for various reasons and he has further followed the party’s campaign trail in the by-elections.
I strongly reiterate that at all times, our conduct as lawyers were entirely professional and Rahimi was not subjected to any form of undue influence or duress as claimed. I find it absurd that all of a sudden, after more than two and half years, and further despite the fact that these statutory declarations were never even used in court and therefore a non issue, it is now being alleged that they have been made involuntarily.
These accusations are manifestly slanderous and malicious and a form of harassment against the party and DSAI’s lawyers. I will be consulting with my lawyers and reserve all rights to initiate legal proceedings against Rahimi.
