Will Anwar be ambushed by trial?

Datuk Seri Anwar Ibrahim has failed in his bid, at the Court of Appeal, to obtain evidence from the public prosecutor about his alleged act of sodomy with a young former aide. Layperson reactions have naturally been cynical, dismissing the judgment as political in nature.

Indeed, the Court of Appeal’s interpretation of Section 51A of the Criminal Procedure Code (CPC), by which it made its judgment, is worrisome from a justice perspective. The judgment nullifies the efforts of the parliamentary select committee which proposed the CPC amendments in 2006 requiring pre-trial disclosure by the prosecution to the defence. The legislature’s intention was to “prevent trial by ambush” but the Court of Appeal’s judgment in Anwar’s sodomy case seems to overturn that principle.

But is Section 51A as clear cut as it is meant to be? And is splitting hairs over its meaning scuppering Anwar’s chances for a fair trial? Continue reading ‘Will Anwar be ambushed by trial?’

Polis Ikut Telunjuk Umno?

Ceramah saya dan Dato’ Chua Jui Meng di Kulai, Johor, terpaksa dibatalkan kerana permit yang telah pun dikeluarkan, ditarik balik selepas mendapat bantahan dari kira-kira 30 orang pemuda Umno! Hanya Tian Chua dan Dr Boo Cheng Hau sempat berceramah.

Alasan yang diberikan Ocpd ternyata tidak masuk akal. Apakah selepas ini jika rakyat beramai-ramai membantah sebarang majlis anjuran umno makanya ianya akan dibatalkan? Saya hanya berkesempatan menyampaikan amanat untuk sekitar 10 minit kepada hadirin sebelum mereka bersurai. Tidak wajar polis mengikut telunjuk umno dan akur kepada sebilangan ahli yang bersikap biadap.

Anwar: We Need Substantive Change

Opposition Leader Anwar Ibrahim told a Pakatan Rakyat seminar yesterday on the two-party system that Malaysia must move from the forms of representation to the substance of democratic experience to give validity to the nation’s founding constitution.

Speaking to several score leaders from PKR, PAS and DAP, the component parties of Pakatan, at the seminar in Kuala Lumpur organised to infuse them with a sense of mission, Anwar held that the country’s democratic beginnings were not sustained because of servile subscription to certain shibboleths.

Changes Small Corruption Big

SEREMBAN: Parti Keadilan Rakyat adviser Datuk Seri Anwar Ibrahim today acknowledged that the Barisan Nasional government was making changes but said these were being delivered in doses that were too small considering the “big scale corruption and leakages” that were continuing.

The government would implement programmes which bring only small benefits to the people and the local mainstream media would highlight these projects, but ignoring the wayward spending by the government ministers and the huge losses due to corruption, leakages and malpractices, he added.

Anwar: Dwi-Parti Hanya Akan Berjaya Jika PR Tonjol Pentadbiran Cemerlang

Sistem politik dwi-parti akan hanya punyai kredibiliti jika Pakatan Rakyat berjaya menjadikan negeri-negeri yang ditadbirnya sebagai pemangkin urus tadbir yang cemerlang, dan pembela golongan miskin.

Sehubungan itu, Ketua Pembangkang Anwar Ibrahim menggesa gagasan itu supaya bertungkus-lumus memastikan Selangor, Pulau Pinang, Kedah dan Kelantan menjadi contoh model pentadbiran mapan untuk diteladani Barisan Nasional.

“Kerajaan negeri perlu menunjukkan teladan melalui dasar-dasar yang dirumuskan. Dasar yang memberi penekanan kepada urustadbir yang baik, kepedulian kepada yang lemah, dan memelihara sumber alam dan bumi,” kata Anwar.

Mantan Timbalan Perdana Menteri ini berkata demikian dalam ucaptama di simposium ‘Pakatan Rakyat dan Pembikinan Sistem Dua Parti’ di Kuala Lumpur hari ini. Anwar Ibrahim menegaskan keputusan PRU-12 lalu menunjukkan rakyat mahu sistem kerajaan dipulihkan, dan bukannya salinan pendua kerajaan Umno-BN. FEER (11/6) Turning A Blind Eye To Human Right

Barack Obama’s firts trip to Asia as president of the United States will come under especially close scrutiny this month from a constituency not often represented at the summit table. The region’s political prisoners and oppressed minorities are looking for a sign that Washington has not forgotten them. It could be a forlorn hope.

Some politicians and activists are disappointed with the Obama administration’s weak stance on human rights and democracy in the region. They question whether it grasps the important role which Asia — in particular Southeast Asia — could play in safeguarding U.S. interests.

Anwar Ibrahim, Malaysia’s former prime minister and current leader of the opposition, is one figure urging more action from the White House. “Using a ‘soft-soft approach’ through diplomatic channels is all very fine,” he says. “But a clear position is required.”

Without such a position, Mr. Anwar argues, regimes in Asia will not change their ways. “Washington’s stance on human-rights issues carries tremendous weight,” he says. “When America states a clear position in support of human rights, freedom and the rule of law, the world listens, and this makes unscrupulous leaders and autocrats think twice before clamping down on the opposition.” Continue reading ‘FEER (11/6) Turning A Blind Eye To Human Right’

Pakatan Rakyat and the Making of a Two Party System

keynote address by Anwar Ibrahim at IKD Symposium on 21 November 2009.

It is a great honour to stand before you to talk about what can be described as a revolution in the collective consciousness of this nation. Last March, by the stroke of the pen, the people of Malaysia shattered all of the preconceived notions that denied the possibility of political change. In place of these old assumptions a new memory of our nation’s heritage and the self-image of its people has emerged.

Until now many of our elected representatives have failed to uphold the mantle of public office. Their interest has been an exercise in greed and avarice and not what Vaclav Havel described as a heightened responsibility for the moral state of society, and to seek out the best in that society and to develop and strengthen it. For it is only with leaders of such caliber that we can expect a government that is fair and abides by the Rules of Law, outlined in a Constitution that grants legitimacy to the very existence of that government. Anything short of this would be an injustice that approaches tyranny.

We had been weaned for many years on the notion that submissiveness and frailty were a prerequisite for the stability of the nation. Our diverse ethnic makeup, rather than an asset, was treated as a powder keg that could be ignited by the slightest spark. Economic development was not compatible with the freedoms that have been established in other democratic nations. On the contrary Malaysian democracy would be circumscribed by profoundly un-democratic rules. There was a freedom of speech but only on certain subjects. The freedom to associate was granted, but only with approved license. Due process, a fair and an impartial judiciary were granted only insofar as they did not encroach upon the vested interests of the rich and powerful. Bombshell 3: Najib’s brother met me, says Bala

Private investigator P. Balasubramaniam has named architect Nazim Abdul Razak as the Malay Datuk who met him at the Curve in Damansara on the night of July 3 last year.

In an interview with three prominent lawyers, Bala says Nazim, the younger brother of the Prime Minister, was with his TV3 celebrity wife when they met outside the Volkswagen showroom.

“He was Datuk Nazim Razak, the younger brother of Najib. He was there with his pregnant wife. Although I did not speak to her, I recognised her as being a TV personality. I think she was the host on the Nona programme,” Bala was quoted as saying.

KL patriotism camps ‘racist and political’

When Hafidz Baharom, a freelance writer, entered a public university in 2002, he was sent with his classmates to a government camp for a week.

It was the usual jungle trekking and other team-building activities, but interspersed with these were lectures. Some of the content was disturbing, he said.

“We were taught a song with lyrics like ‘the land that you walk upon is owned by others. Lecturers told us the Malays were forced to depend on the Chinese for support after 1998 because some Malays had betrayed their own race,” he recalled. Sasterawan Jerman, Gotthold Ephraim Lessing menuliskan naskhah lakon “Nathan der Weise: Puisi Dramatik Dalam Lima Aksi” (1778-1779) dengan latar “Perang Suci” (Kings’ Crusade”) atau dikenali juga sebagai Perang Salib ketiga (1189–1192).

Karya ini adalah gambaran bagaimana toleransi [juga kebijaksanaan] adalah keperluan yang memungkinkan tiga ugama (Islam, Yahudi dan Kristian) menempuh pancaroba demi kekal hidup aman damai bersama di “tanah suci” al-Ard ul-Muqaddasah.

Dalam pengantar “On Humanity In Dark Times: Thoughts about Lessing” edisi terjemahan Inggeris (2004) terhadap karya-karya Lessing, intelektual asal Jerman, Hannah Arendt antara lain berkomentar:

Ia susah kepada kita hari ini untuk mengindentifikasikan dramatik namun konflik yang tidak tragik di dalam “Nathan Yang Bijak” sepertimana perhatian Lessing. Sebahagiannya kerana perhatian kepada kebenaran telah menjadi persoalan yang kepada kita sudah tentunya untuk berkelakuan toleransi, meskipun ke atas sebab yang baru sahaja ada sebarang kaitan dengan alasan Lessing itu.

Toleransi, dalam maksud Hannah adalah kelakuan yang tidak boleh ditangguh-tangguh, esok-esok. Di era Nazi, karya Nathan der Weise itu diharamkan.
