In response to inquiries from the media, we wish to clarify Rohaizat Othman’s status as an advocate and solicitor.

The Advocates and Solicitors Disciplinary Board struck Rohaizat Othman off the Roll of Advocates and Solicitors on 7 March 2008 after he was found guilty of misconduct. The Disciplinary Board’s decision arose from an investigation into the complaint lodged against Rohaizat Othman by the purchaser of a piece of real property. According to the complaint, Rohaizat Othman failed to refund almost RM 161,000 to the complainant after the transaction was aborted.

Rohaizat Othman appealed against the decision of the Disciplinary Board to the High Court, and the appeal was dismissed on 12 August 2009. He is therefore legally disqualified from practising as an advocate and solicitor.

The finding of misconduct is personal to Rohaizat Othman, as the Disciplinary Board would not hold a lawyer liable for the actions of his/her law partner(s).

Tan Sri Muhyiddin Yassin, Timbalan Perdana Menteri dan Timbalan Presiden Umno, baru-baru ini terselamat dari terlibat dengan tragedi apabila helikopter Nuri milik TUDM yang dinaikinya terpaksa membuat pendaratan cemas di Tuaran disebabkan cuaca buruk.

Sambil mengucapkan syukur atas terhindarnya Muhyiddin dari tragedi, Saudara Ahmad Nizam Hamid, Penasihat Undang-Undang PKR Negeri Pahang sempat melontar persoalan yang terbit berikutan kejadian tersebut.

Ini kerana Muhyiddin menaiki helikopter Nuri milik TUDM tersebut untuk ke Lapangan Terbang Antarabangsa Kota Kinabalu setelah selesai merasmikan Persidangan Perwakilan Umno Bahagian Kudat. Pada petang hari yang sama, Muhyiddin dijadual akan merasmikan pula Persidangan Perwakilan Umno Bahagian Penampang.

Nizam mempersoalkan kenapa Muhyiddin dibenar bagi menggunakan helikopter milik tentera, milik kerajaan untuk kerja-kerja partinya, Umno?

Kalau lelaki-lelaki berselempang merah yang bersatu sepertinya sebuah rejimen tentara meneruskan serangan ke bandar Pengaram, dikhuatiri keluarga Dato’ Onn anak-beranak habis dibunuh—barangkali dibakar hidup-hidup di rumah mereka oleh segelintir Cina yang dipercayai Komunis, yang, mengepung sejak dini hari.

Sepuluh batu di belakang, di Pekan Semerah, sudah ‘banjir’ pekan sebatang itu dengan apa yang saya dengar sebagai “darah Cina.”

Cek Ijam ada di sana, kala Dato’ Onn merayu agar jangan diteruskan niat membunuh segala Cina di Bandar Pengaram.

Salleh pun muncul tiba-tiba, dari celah-celah, apabila berlangsung proses yang seperti sebuah negosiasi dan rundingan dengan Dato’ Onn. Ketika Salleh muncul, Cek Ijam mendengar seketika. Kemudian dia ‘mengundur’, melangkah agak ke belakang daripada tegaknya mula-mula yang tak jauh daripada di mana Dato’ Onn berdiri—sementara dialah yang dikatakan mengepalai secara rahsia ‘perang’ itu.

Sejak itu, Salleh mula diangkat sebagai jagoan Melayu Semerah; Melayu Batu Pahat.

Nama Salleh disebut sebagai “Panglima.”

Nama Cek Ijam tersorok. Tak pernah terdengar, sehinggalah umur saya 32 tahun… begitu lama bukan? ~ Tapi, tugas membawakan sesuatu yang benar, takkan pernah punya tarikh hujungnya.

Sebelum ahli-ahli Umno akar umbi itu turun ke Dataran Pengaram petang ini, dan melaungkan “Anwar pengkhianat bangsa!”, saya perlu ceritakan tentang inspirasi perjuangan Dato’ Onn Jaafar—nama yang selalu diingatkan kepada saya sejak kecil. Sebuah sisi sejarah yang barangkali tidak ahli-ahli Umno itu tahu, selain kepatuhan melulu kepada pemimpin-pemimpin yang mahu meneruskan angkara murka.

Petang itu, Dato’ Onn bersama beberapa pengikutnya menahan pasukan lelaki Melayu yang kemudiannya dikenali sebagai “Selempang Merah” daripada meneruskan niatkan ke bandar Pengaram. Kata orang tua-tua, habis sudah orang-orang Cina dibunuh dalam amukan itu—“Perang Parang Banjar”. Peristiwa itu juga dikenali sebagai “Perang Banjar.”

KUALA LUMPUR, Aug 18 – Nearly as soon as he filed his papers to contest the Permatang Pasir by-election yesterday, Umno candidate Rohaizat Othman ran into controversy.

Rohaizat, 38, was bombarded with questions from reporters after it became known that he was disbarred as a lawyer last year over allegations of fraud that implicated his law firm.

According to the Malaysian Bar website, he was disbarred on March 7 last year. This means that he cannot practise as a lawyer or appear before a court, but he is allowed practise syariah law.

It also does not preclude him from standing as an election candidate, but it is certainly not an advantage.

He and Parti Islam SeMalaysia (PAS) Penang commissioner Mohd Salleh Man,

52, were the only two who registered as candidates for the by-election on Aug 25.

The by-election for this state seat on mainland Penang was called after the previous PAS assemblyman died, making it the country’s eighth by-election since the general election took place in March last year.

Scientists in Israel have demonstrated that it is possible to fabricate DNA evidence, undermining the credibility of what has been considered the gold standard of proof in criminal cases.

The scientists fabricated blood and saliva samples containing DNA from a person other than the donor of the blood and saliva. They also showed that if they had access to a DNA profile in a database, they could construct a sample of DNA to match that profile without obtaining any tissue from that person.

“You can just engineer a crime scene,” said Dan Frumkin, lead author of the paper, which has been published online by the journal Forensic Science International: Genetics. “Any biology undergraduate could perform this.”

Addendum : Commentator Tennou Heika felt my proposed sms was not quite good enough.

He commented that it might be perceived by recipients as mere propaganda as it did not contain enough factual detail.

He’s right.

Thankfully, he sent in a proposed sms which, I think, does the trick. Let’s use this, people.

For the third successive week, the Umno propaganda apparatus ground out the theme of traitor to race and country, in sustained volleys that showed that a tipping point has been passed at which the shrill are held in precarious check.

For the tremors of desperation audible in Umno’s attacks on Pakatan Rakyat and its pied piper, Anwar Ibrahim, were unmistakable. Even Dr Mahathir Mohamed was enlisted; not that it would take a lot for an inveterate Anwar hater like him to join the offensive. But the vacuous nature of the attacks surprised.

It is truly despicable that Deputy Prime Minister (DPM) Muhyyuddin would see fit to label the leader of the loyal opposition Anwar Ibrahim a traitor. I expect such infantile name calling and boorish behavior from the likes of UMNO Youth leaders and mainstream media editors, not from a DPM.

Muhyyuddin has yet to learn that as DPM he is leader of all Malaysians, not just of UMNO and Barisan supporters. In mentality and behavior he remains a parochial UMNO politician, not a national leader. He has yet to make the necessary transition to being the occupant of the second highest office in the land, and literally a heartbeat away from being Prime Minister.
