Seni Retorika

I would like to believe that I am well trained in the art of rhetoric. It is a case of “syiok sendiri”, of course. But then again, if I am not even able to be “syiok” about myself, how would others be “syiok” with me? And today, in the spirit of “syioksendiri-ism”, may I bore all of you with my thoughts on this subject.

It is common knowledge that some of our Ministers – and members of Cabinet – are quite intellectually challenged. This is obvious from the various statements which they make in public. Zahid Hamidi’s “we must respect their culture” – when he was trying to deflect the embarrassment caused to the BN, and himself, caused by the Chinese sexy concert – was but one example of an absolute failure of the brain to take control of the tongue.

Further back in time, Nazri Aziz’s “he called me because I am his Minister” – uttered while attempting to explain why the Lord President called him to issue a denial respecting the Linggam tape – was a shining example of a lack of appreciation of how the legal system worked.

Mahathir Mohammad is a champion when it comes to rhetoric. After his retirement, he is fond of laying the blame for everything which has gone wrong on everybody but himself. “I did not sack Tun Salleh, the tribunal did”, said him. Of course, he forgot that he was the one who established the tribunal. “I did not put Anwar in jail, the Court found him guilty and put him in jail”. Yes, yes, haven’t we all heard of that too. “I did not destroy UMNO, Abdullah did”. “I did not this, you did”.

The Economic Effect of Judicial Decisions

A consideration of the economic consequences of poor, corrupt or biased judicial decision making after considering a brief example of such a decision, the oath of a judge as found in Schedule Six of the Federal Constitution by one Mr. Fahri Azzat.

As it stands, the Federal Court still owes not just the litigants but the general public (particularly Perak) its reasoned (hopefully) considered (fingers crossed) written judgment for its decisions in the Sivakumar case which fly in the face of Article 72(1) of the Federal Constitution which simply provides:

The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court.

I think that even if you aggregated all the judges in the judiciary (hell, throw in the entire Commonwealth as well), you could not reasonably justify such a decision. And should they even been doing that? Well, not according to their very own oaths, which can be found in the paragraph 1, of the Sixth Schedule of the Constitution which is as follows:

“1. Oath of Office and Allegiance

“I, …, having been elected (or appointed) to the office of …. do solemnly swear (or affirm) that I will faithfully discharge the duties of that office to the best of my ability, that I will bear true faith and allegiance to Malaysia, and will preserve, protect and defend its Constitution.”

“(NOTE – A judge of the Federal Court, other than the Chief Justice, a judge of the Court of Appeal or of a High Court or a judicial commissioner shall use the words “my judicial duties in that office” in place of the words “the duties of that office”.)”

Anwar: Najib’s tough stand masks fear

The government’s crackdown on dissent in recent weeks reflected the hardline political stance of the current Putrajaya administration, charged Opposition Leader Anwar Ibrahim.

The PKR chief pointed out that the police force’s tough action to clampdown on peaceful gatherings, candlelight vigils, protests and even DVD screenings demonstrated the intolerant politics of Prime Minister Najib Abdul Razak

Condemning yesterday’s police raid on DAP headquarters in Petaling Jaya, he said it reflected Barisan Nasional’s fear on the emergence of Pakatan Rakyat as genuine and viable alternative government-in-waiting.

He said the DAP’s office was raided merely because the party was part of Pakatan set up.

“That’s the only crime DAP has committed,” Anwar, the Permatang Pauh member of parliament, told some 5,000 people at a Penanti by-election rally in Berapit, Penang last night.

Ibu pejabat DAP diserbu polis

23 Mei 2009 – Sepasukan pegawai polis menggeledah ibu pejabat DAP di Petaling Jaya dalam siasatan terhadap sekumpulan penyokong parti itu yang ditahan di Ampang Jaya kelmarin.

Sebelas anggota tiba di pejabat jam 6.25 petang tadi di Taman Paramount bersama ahli Majlis Daerah Hulu Selangor, Ooi Leng Heng yang berpakaian seorang tahanan reman.

Ooi direman dua hari di balai polis Ampang dalam perhimpunan nyalaan lilin bersama ADUN Teratai, Jenice Lee, Khamis lalu.

Dalam serbuan kira-kira sejam itu, polis turut merampas satu unit komputer, cakera padat dan alat pendengar digital.

Catatan Penanti

Saya menegaskan kepada pengundi Penanti bahawa pertarungan masih di antara Pakatan Rakyat dan BN. Perhatikan saja bilamana media UMNO-BN terus mencerca Keadilan dan PR. Bedanya, kali ini mereka mengaku lemah menghadapi tahap kesedaran dan kegigihan rakyat di Permatang Pauh.

Sebelum ini umno-bn telah berhempas pulas mengugut dan menghukum rakyat disini dengan menahan banyak projek pembangunan; mencera dan memfitnah saya. Dan kemuncaknya di bulan Ogos tahun lalu, rakyat Permatang Pauh termasuk Penanti telah menghumban mereka.

Maka berwaspadalah dengan fitnah dan helah tipudaya mereka. Jentera kita perlu siap siaga, jangan anggap enteng tanpa musuh nyata. Bekerjalah dengan ikhlas dan sekuat daya. Inshaallah kita akan menobatkan Sdr Mansor sebagai ADUN dan Timbalan Ketua Menteri 1 Pulau Pinang.

Sesudah itu kita akan berduyun ke Manek Urai.

Polis Jangan Bertindak Keterlaluan

Ceramah di Bukit Berapit, Bukit Mertajam turut dihadiri Sdr Lim Guan Eng, Dato’ Seri Nizar, Dr Lee Boon Chye dan sudah pastinya calon Keadilan Sdr Mansor Osman. Dalam ucapan tersebut saya mengecam tindakan pihak polis yang menyerbu Ibu Pejabat DAP di Petaling Jaya petang tadi.

Serbuan tersebut yang dibuat tanpa sebarang waran geledah dan dipercayai bermotifkan kepentingan politik umno-bn merupakan satu penghinaan ke atas Perlembagaan dan Kedaulatan Undang-Undang. Saya menggesa agar pihak polis dengan memohon maaf di atas tindakan yang membelakangkan undang-undang serta dengan segera memulangkan harta yang dirampas.

Rakyat Kecewa Dengan Keputusan Mahkamah Rayuan

Keputusan Mahkamah Rayuan sungguh mengecewakan! Tetapi tidaklah pula mengejutkan! Ramai yang menjangka keputusan Mahkamah Rayuan akan memihak kepada umno-bn. Namun tidak kurang pula yang mengharapkan agar munculnya suara hakim yang tunduk kepada hukum dan damir. Inshaallah rakyat Penanti akan memberikan jawapan sebaiknya.
