Perak Sultan Must Intervene and Call for Fresh Polls

By Param Cumaraswamy

The present crisis in Perak could have been averted if His Royal Highness Sultan Azlan Shah had dissolved the Legislative Assembly on February 5.

The present scenario in Perak is seen as a State without a legitimate government.

The casualty in such an environment primarily is the rakyat. If the situation is not carefully addressed and arrested quickly the rule of law in Perak will be in jeopardy and anarchy will be the order of the day.

Our Rulers are not absolute monarchs. They are in essence constitutional monarchs. Their decisions are not absolute. The implications of their decisions can be discussed and commented by the people and the media.

The ramifications of the decision not to dissolve the Legislative Assembly on that day are now seen, heard and felt.

This is not the time to look into the technicalities and strict interpretation of the law and the constitution.

This is not even the appropriate occasion for the intervention of the courts.

There is a higher constitutional principle namely the doctrine of separation of powers to be protected. It is ultimately for the rakyat of Perak to decide their own destiny.

That is what democracy is all about.

There clearly appears a situation where no one member of the legislative assembly could command the confidence of the majority in the same Assembly.

I therefore appeal to His Royal Highness to dissolve the Legislative Assembly and pave the way for fresh elections. Let there be a government of the rakyat, by the rakyat and for the rakyat in Perak.

I agree with the writer. On what basis the Sultan refuses to dissolve the State Assembly?
It just doesn’t make sense. In this kind of situation, the rakyat will turn to the Sultan to clarify this matter, accordingly due to the State Constitution. And it is very clear there’s a power struggle between the two parties BN and PR. Dissolving the State Assembly is the Sultan’s prerogative and rights of power. This is the time for His Royal Highness to use it. And why not? After all, the rakyat will determine who’s the government of the day. The Sultan should see the matter as a gravely concern as it affected the rakyat, directly and inderctly. Thus, I plead for the Sultan to dissolve the State Assembly.

Apa kata semua?..

“I think that constitutional rule in Perak has collapsed and the only way to rectify the situation is to go back to the people,” Tengku Razaleigh told BT in an exclusive interview yesterday. “That would be the appropriate thing for the Ruler to do.”

For whatever personal reasons the Sultan or his family may have, surely he cannot completely ignore the constitutional crisis in his state. He can’t lock himself up in his palace and let his state to drift aimlessly without a government.

The rakyat are getting increasingly impatient, and are bitterly disappointed that their Sultan is not stepping in to resolve the impasse. They feel so let down and are crying out for their Sultan to let the rakyat decide who should lead the assembly again. Let’s hope the Sultan will use his wisdom to dissolve the assemble and call for fresh elections.

Your Royal Highness Sultan Azlan Shah, please take this opportunity to call for fresh polls. Your people will respect you and thank you for upholding their wishes.
Fresh polls will end all arguments as to which party has the rakyat’s support.
Your Royal Highness Sultan Azlan Shah can make it all possible. The power is in your hands, Tuanku.

    Pauline,

The Sultan is bound by the state constitution to act upon the advice of the MB in seeking for a dissolution of the state assembly. HRH’s role is merely symbolic in granting His consent to the MB’s request. This is the basic rule and principle contained in our constitution.

Anyway, your unsavoury comments of Perak and Ipoh shows how desperate you are. Tell you what, let’s have new elections in Perak so that the rakyat can clean up the state of crooked politicians from BN-UMNO. After that, we can consider extending the gotong-royong campaign nationwide. In due time, Malaysia will be a super-clean country free from corruption.

Political party comes and goes. The sultan must remember, his subjects are there to stay.
If the sultan expect mutual respect, he cannot ignore the desperate cries from his
subjects, to elect a govt of their choice.
So the question hovering in the mind of Tuanku Azlan Shah is, who do you value more?
A political party with no principle or the helpless rakyat who want a govt of their
    choice?!
A wise man acts a coward stays mute!

Yes.. even with nobody got suspended or resignation invalid, those 3 jumping frog will not show their face ever… as they’ll be afraid of their constituencies and ex colleague in PR… as well as media focus on them… This means.. the DUN will be tied at 28-28 and if we exclude the speaker.. it will be 27 PR vs 28 BN and this means… every ADUN must be in the DUN all the time… even cannot go to the tiolet while the DUN is in session… hehhehe the answer is to dissolve the DUN…

Everything changes in this world. There is no such thing as permanency. So anything can happen in Perak in particular and anything can happen in Malaysia in general.

We have to make the majority of Malaysian masses wakeup and let them know that they are the judge of the country instead of the ruling political party.

When the Sultan of Perak made that decision I thought it wasn’t him. HRH was the chief judge and could not possibly made such an unwise decision. There must be a very strong reason for him to make such a decision without wisdom and people concern.

If it was his unintentional decision then HRH should do something to correct his mistake. He should make the right decision to show the rakyat that he cares for them. He is not a person who could be pulled by the nose. He must come up with something more beneficial for the state and Perakians. Though it is not a very simple task to right his own wrong but by doing so he would bring tremendous improvement to the state. HRH should leave his pride behind. Otherwise Perak would remain as it is.
