Salam Hormat,

The Human Rights Commission (Suhakam) today expressed disagreement with the manner in which the political crisis in Perak was handled.

The commission felt that only a fresh elections could resolve the uncertainty, especially when the legality of the resignation letters of the three Pakatan Rakyat state assemblypersons is in doubt.

Suhakam was responding to the ‘political coup’ staged by Barisan Nasional following the resignation of the four state assemblypersons.

While Pakatan had called upon Sultan Azlan Shah to dissolve the state assembly and call for a snap polls, the Perak ruler has opted to consent to the formation of a new state government.

However, Suhakam reminded the concerned parties that it is the basic human right of the people to choose the government of their choice.

“It appears that the method adopted in forming the new government for the state of Perak is questionable, consequently so is the legitimacy of the new state government.

“Suhakam noted that the Sultan of Perak has not consented to the dissolution of the state legislative assembly.

“Suhakam is of the opinion that new elections for the state legislative assembly, in line with the principle of human rights, will resolve the political uncertainty of the state government.”

There is no provision for a ruler of a state to dismiss a chief minister or menteri besar, and a ruler can ask the chief minister to resign only after the latter has lost a motion of no confidence in the state legislature.

These constitutional precedents were established by the High Court in Sabah in the famous case involving Mustapha Harun against Mohd Adnan Robert and Joseph Pairin Kitingan in 1985.

The Sabah state election in April 1985 had issued in Mustapha’s United Sabah National Organisation (Usno) winning 16 seats, Pairin’s newly-formed Parti Besatu Sabah (PBS) gaining 26 seats and Datuk Harris Salleh’s Berjaya garnering 6 seats.

In a dramatic development following the counting of votes, a delegation headed by Mustapha went to Mohd Adnan’s official residence in the early hours of April 22 and got the governor to swear him in as chief minister.

By morning the same day, Mohd Adnan revoked the appointment and later swore in Pairin as chief minister.

Mustapha took both Mohd Adnan and Pairin to court but in a landmark judgment Justice Tan Chiaw Tong of the High Court in Sabah upheld the following precedents – that a ruler can appoint as chief minister an elected member of the legislature who in his opinion enjoyed the confidence of a majority of the members; and, that once appointed a chief minister was obliged to resign only after he had lost a vote of no confidence in the legislature.

The blame is now twisted to say Anwar started it and UMNO is finishing it. Far from the truth of it all!
He reported what went on in Perak, sincerely when one UMNO man resigned and join PR. Is that snatching and bribing?

That man went back to UMNO. Why? No bribes from Anwar?

Did Anwar use money to bribe anyone? He made predictions, but it did not materialized. Did we not see the events why they did not materialized?

From The Straits Times
IPOH (Malaysia) – MALAYSIA’S opposition refused a royal command on Thursday to give up control of a northern state where the government says it has seized power, setting the stage for a political crisis.

The Perak state government building has been surrounded by a large police contingent including riot squad, while thousands of opposition supporters held a protest at the chief minister’s residence, eyewitnesses said.

Perak’s royal ruler, Sultan Azlan Shah, earlier on Thursday refused the opposition’s request to dissolve the state assembly, after its narrow majority was snatched away with the defection of four lawmakers.

After meeting with deputy premier Najib Razak who said the Barisan Nasional coalition now had the numbers to control the assembly, the sultan asked chief minister Mohammad Nizar Jamaluddin and his executive council to resign.
