KUALA LUMPUR, Dec 17 — Lawmakers from both Barisan Nasional (BN) and Pakatan Rakyat (PR) raised questions today about a law to set up the Judicial Appointments Commission (JAC), suggesting the Bill put before Parliament contained unconstitutional provisions.

While the criticisms are not likely to spell defeat for the second of Prime Minister Datuk Seri Abdullah Badawi’s reform bills, it could result in the need for amendments to be made to the provisions before it is passed.

KUALA LUMPUR: The Judicial Appointments Commission (JAC) Bill was passed in the Dewan Rakyat at 7.58pm on Wednesday despite the misgivings of Opposition lawmakers.

The Bill paves the way for the Government to set up a Commission to filter candidates before recommendations are made to appoint High Court judges and above.

KUALA LUMPUR : Opposition Leader Datuk Seri Anwar Ibrahim (Permatang Pauh -PKR) expressed conditional support for the Malaysian Anti-Corruption Commission Bill (MACC) during its second reading in parliament yesterday but registered his reservations on some of the clauses.

One major concern is the lack of power given to the commission to initiate prosecutions. Under clause 58 of the MACC Bill, prosecution will be carried out by the public prosecutor from the Attorney-General’s Chambers.

Anwar noted that over the years, corruption in the country had become more severe. The AG’s Chambers, and in particular, AG Tan Sri Gani Patail, he said, had been linked with too many allegations of abuse of power and corruption.

MIRI: Opposition Leader Datuk Seri Anwar Ibrahim went on a “trouble identification” exercise in central and northern Sarawak of issues which he said should be accorded national attention.

The PKR adviser visited Sibu, Belaga, which is near the controversial Bakun hydroelectric dam project, and Sibuti where thousands of people were facing possible eviction.

At a dinner on Sunday here, Anwar publicly named state political leaders whom he claimed were involved in nepotism and cronyism.

RANG UNDANG-UNDANG SURUHANJAYA PELANTIKAN KEHAKIMAN 2008

LATAR HUJAH

Badan Kehakiman merupakan salah satu daripada tiga cabang utama dalam pemerintahan yang berteraskan sistem demokrasi berparlimen yang seharusnya bebas daripada pengaruh dan campurtangan Eksekutif.

Selain dilindungi kebebasannya, badan kehakiman harus berwibawa serta tidak tergugat dari segi keyakinan rakyat terhadap kebebasan dan kewibawaannya.

Jika kebebasan badan kehakiman dicabuli, kewibawaannya dipertikaikan dan keyakinan rakyat terhadapnya terjejas, maka sistem keadilan kita menjadi pincang dan kedaulatan undang-undang [rule of law] menjadi ranap merudum, justeru rakyat jelata terdedah kepada penindasan, kezaliman dan salahguna kuasa pemerintah tanpa pembelaan menurut hukum dan nilai-nilai keadilan.

Saya mengucapkan terima kasih kepada Tuan Yang DiPertua kerana memberi kesempatan untuk bersama-sama membahaskan rang undang-undang yang berhasrat untuk menubuhkan sebuah Suruhanjaya Anti Rasuah.

Tuan Yang DiPertua:

1. Rasuah merupakan jenayah yang paling merbahaya kepada masyarakat dan negara ini. Ianya umpama wabak yang menghancur luluhkan negara dan harapan rakyat keseluruhannya.

2. Rasulullah s.a.w. bersabda: ‘la’anallahur rasyi walmurtasyi warraisy’,
Allah melaknat yang menerima rasuah, yang memberi rasuah dan yang menjadi perantara rasuah.

KUALA LUMPUR, Dec 15 – While Pakatan Rakyat today welcomed the Prime Minister’s new Bill to fight corruption in Malaysia, it is resisting the federal government’s effort to make it a law until certain changes are made to give more power to the Malaysian Anti-Corruption Commission (MACC).

The Opposition Leader wants the MACC to be given full discretion to charge in court those who have been investigated and found to have strong proof of corruption against them directly, instead of giving that power to the Attorney General’s Chambers, as is done now.

Datuk Seri Anwar Ibrahim told Parliament that the issue at stake is the integrity, authority, and qualification of the Attorney General (AG) and the judiciary.

—KENYATAAN MEDIA UNTUK EDARAN SEGARA—

KUALA LUMPUR, MALAYSIA, 15 DISEMBER 2008

Rasuah merupakan jenayah yang paling merbahaya kepada masyarakat dan negara ini. Ianya umpama wabak yang menghancurkan negara dan harapan rakyat keseluruhannya.

Selaku Timbalan Perdana Menteri, ketika perbahasan Akta Pencegahan Rasuah 1997 di antara lainnya saya ada menyebut, “Gerakan membanteras rasuah di Malaysia harus dilihat secara positif. Ia bukan agenda politik tetapi ia adalah agenda pembangunan bangsa kerana rasuah merupakan kuman yang boleh merosakkan pemerintahan dan negara. Rakyat menyedari rasuah merupakan hambatan-hambatan utama bagi kemakmuran negara.”

Kerajaan BN tidak boleh lagi berada dalam keadaan penafian. Berhadapan dengan krisis ekonomi sejagat, seharusnya membuatkan kita lebih peka dan bertanggungjawab untuk menyelamatkan negara ini serta menjamin kebajikan rakyat.

Negara ini tidak mampu lagi menanggung skandal salah urus tadbir dan ketidak telusan di dalam menjalankan urusan yang melibatkan dana awam. Saya percaya ahli-ahli parlimen sekalian, melewati sempadan kepartian, pastinya bersetuju inilah masanya untuk bertindak. Kita tidak boleh berdolak dalih lagi untuk membuat keputusan.

Adalah diharapkan pembentangan rang undang-undang ini bukanlah sekadar untuk meredakan persepsi negatif orang ramai atau pelabur tetapi sebagai usaha murni kearah membanteras rasuah habis-habisan dari peringkat tertinggi kerajaan hinggalah ke akar umbi masyarakat.

Walaubagaimanapun sekiranya perlantikan Ketua Suruhanjaya, menurut seksyen 5(1) dan seksyen 5(3) serta Lembaga Penasihat Pencegahan Rasuah berasaskan seksyen 13(2)(a), masih di atas nasihat Perdana Menteri, makanya harapan agar sebuah suruhanjaya yang telus dan bebas ditubuhkan tidak akan terlaksana. Bagi memastikan Suruhanjaya tersebut bebas, ahli-ahlinya mestilah dilantik oleh Jawatankuasa Khas Parlimen agar calon yang paling layak sahaja dilantik, bukan sahaja dari segi teknikal tetapi juga bersih dari tuduhan dan celaan.

PETALING JAYA, 12 Dec 2008: The Judicial Appointments Commission (JAC) Bill that was tabled for first reading in Parliament on 10 Dec is a disappointment, said lawyers and ex-judges.

Several aspects of the bill did not address the concerns of the judiciary, namely the interference of the executive in judicial appointments, and the promotion of judges.

KUALA TERENGGANU, Dec 14 – Situated in the middle of Kuala Terengganu town, Kampung Cina, the area with the highest concentration of Chinese in the Parliamentary constituency, may decide which party wins the seat.

And Datuk Mukhriz Mahathir’s recent remarks about abolishing vernacular schools appears to be turning into a major issue that could swing the voters there who are traditional Barisan Nasional (BN) supporters away from from the ruling coalition.

DEC 13 — The tabling of the Judicial Appointments Commission Bill 2008 in Parliament is a momentous event for what it implies.

For far too long, civil society’s concerns about the state of the judiciary had gone unaddressed by the Government. It seemed that the acknowledgments this would require, and their implications, were too problematic for the Barisan Nasional to generate the political will this would require.

Dear all,

I am upset. I read Datuk Seri Anwar’s notes on the debate, and saw Tony Phua’s press statement.

The UUCA amendments are making our educational system more ridiculous, especially concerning allowing only “experts” to talk about issues and to be invited to forums. This a good example of the “total bastardization of specialization” and to make sure that divide and rule is total. With UUCA the Akujanji, student apathy, Mat Rempitism, more TV channels, more “infotainment” and all these amendments, more (more…)
