We act for Dato’ Seri Anwar bin Ibrahim.
On or about 19 August 2008, you uttered and caused to be published in
the Kwong Wah Jit Poh chinese newspaper, an article captioned “Anwar
Harrassed My Wife” (’the article’) which referred to our client. Inter
alia, the article contained the following defamatory words about our
client:
“Deputy Housing and Local Government Minister Datuk Hamzah Zainuddin
revealed that Dato Seri Anwar Ibrahim harassed (kacau) his wife in
1998. Anwar wanted to take advantage of his friend’s wife even though
they were still best friends. Therefore, he thinks that the voters
should not vote for Pakatan Rakyat under the helm of such person.”
(translated by qualified translator) (hereinafter known as “the
impugned words”)
The impugned words that you published in the article, mean and were
understood to mean that our client, inter alia:-
1) have directly and/or indirectly and/or by innuendo, given an
impression and the perception that our client is engaged in illicit
sexual activities and/or habitually engages in similar activities;
2) is a man of low morals;
3) is a man of no Islamic values and
4) is a bad character.
Our client contends the following:-
a) your utterances of the impugned words as stated above of our client
are and were grossly negligent, reckless, irresponsible, deliberate,
malicious and aimed to lower our client’s esteem in the eye of the
public and expose our client to public hatred, scorn, odium, contempt
and ridicule;
b) your utterances of the impugned words as stated above of our client
are motivated by mala fides, distortion of facts suggesting moral and
legal impropriety on the part of our client and are principally done
in your pursuit of seeking cheap publicity, sensationalism;
c) your utterances of the impugned words as stated above of our client
are pre-mediated and calculated to tarnish, malign, defame and
seriously injure the good name and character of our client;
We are further instructed that you have or caused to have republished
the following impugned words.
The allegations in the article and the comments i.e. impugned words
against our client amount to a very serious libel on our client and
have caused him considerable distress and embarrassment. These
allegations made against him are false and your attack on him is
wholly unjustified.
We are therefore instructed to demand, which we hereby do:
1) An immediate and unequivocal public retraction of the impugned
words from the said Kwong Wah Jit Poh newspaper and the removal of all
the offending and defamatory comments forthwith.
2) An apology in terms to be approved by us as solicitors to be
published in newspapers of our client’s choice.
3) An undertaking by yourselves not to repeat the above impugned
words, allegations and comments.
Our client has also instructed us to demand damages from you for the
injury caused to his reputation in the sum of RM10,000,000-00 (Ringgit
Malaysia Ten Million).
Our client has also requested us to demand payment of all legal costs
that has been incurred with regard to this matter.
This letter is written in accordance with the pre-action protocol
prior to the institution of a libel action. We look forward to hearing
from you without delay. If we do not receive a satisfactory reply
within forty-eight (48) hours of receipt of this letter, our
instructions are to institute legal proceedings. In the meantime, our
client reserves all his rights in this matter.
Kindly acknowledge receipt accordingly.

This battle between you, DSAI and your political opponents is like a Bollywood, Tollywood, Kollywood or even Hollywood Movie where the sole, brave hero faces his opponents one by one with all the dishum, bishum, gishum stuff. I can see the Saiful saga unfolding into the Dato Hamzah Zainuddin saga, then into the ……..saga as each episode loses its lustre, attraction and grip on the masses and vanishes into oblivion. It must take many heads to come out with one plot after another. Now we have SHA coming out with the tabling of the DNA Bill on the side. Why didn’t he come out with that bill earlier when Nurin and other unfortunate souls like her were sexually abused and murdered? Why is he in a hurry now to table it when DSAI is marking time to return to Parliament and heading towards Putrajaya? Is Nurin’s death of lesser importance than DSAI’s challenge to BN?

Semoga DS dapat menangkis segala tohmahan dengan berjaya. Risau rasanya dengan bermacam drama keluar mengaitkan DS. Serangan bertalu2 dari semua arah nampaknya. DS rasa boleh selamat ke dengan situasi ini? Adakah strategi pihak mush sudah dibaca, dan telah ada strategi juga untuk DS melawan segalanya? Berdebar hati ini apabila PRK yang semakin hampir ini. Risau dengan rancangan jahat pihak musuh dengan penggunaan semua agen kerajaan yang ada, agen polis, SPR, BPR, JAWI, mcm2 lagi. In addition to my blogs here, I would like to bring out this very important view point. A person with a voracious appetite for sex and matters related to sex will find very little time for political speeches, meetings and assemblies, social gatherings, wooing the crowd for a by election etc….A person engaged in such sexual inclinations will have no time for any other human being except himself and would be totally engrossed in his sexual fantasies.
In the first place, a person who is so actively involved in the line of work and duty, as in the case of DSAI, I feel he would not even have the time to even look at himself properly in the mirror. Maybe it would be even days when he had a meal together with his wife and family. So in a situation like this even an idiot can clearly see that DSAI has no time for a sexual rendezvous or fling with any guy or gal. Period.

This plot set up is quite common to derail someone’s career or political ambition, and this practice have been quite rampant since 1998.
The lady (or man) will make some come on phone calls and “coincidently” meet the man on specific occasions, and then if the man gave her/him a cold shoulder, of course, she/he would make claims of harassment or whatever sexual connotations she or he can think of, to demoralise the man. This psycological human behaviour is quite rampant today, whereby, some women or men, would go through such extreme accusations, if their bad wishes are denied. By right, both the accuser and the accused should be thoroughly investigated, before any accusing statements are being brought known to public, to avoid unnecessary and shameful character assasinations.
In Islam, this is not a practice.
We pray to Allah The AlMighty, for protection from fitnah, and be stronger in faith and obedience to Allah The AlMighty’s teachings in the Holy Quran and Practice Prophet Muhammad’s (s.a.w.,Peace Be Upon Him) Sunnah Rasulullah and sayings from the Hadith soheh. And we pray also to Allah The AlMighty, for Dato’ Seri Anwar Ibrahim’s victory in the by-election for MP at Permatang Pauh on 26th August 2008, InsyaAllah, Amin ya RobbalA’lamin.

Kita kena serahkan kepada Allah siapa benar siapa salah dalam isu semasa politik sekarang.. Saya yakin Allah akan tunjukkan kebenaran jika kita memintanya..

Jika DSAI yakin tidak bersalah tidak perlu takut… Namun jika ada kesalahan tidak perlu bimbang kerana AMPUNAN ALLAH melebihi KEMURKAANNYA.Taubat sangat disukai Allah..
Jangan dibiarkan Saiful bukhari dituduh menerima wang kerana ini boleh menjatuhkan maruahnya sedangkan ia tidak dibuktikan dengan apa apa.Jika Saiful menipu Allah akan membalasnya. Jika Saiful berkata benar Allah akan membuktikannya.

Jadi biarkan Allah membalas dengan petirNya,batuNya dan apiNya. Kita tidak perlu menuduh siapa siapa.Termasuk menuduh Najib dengan Altantunya atau dalang apa apa dll…..Serahkan kepada Allah.
Ikut pengalaman kita, duit tidak berkat ini akan hancur dengan sendiri.. Kereta dari duit haram akan dibakar Allah. Rumah dari duit haram akan dimusnahkan Allah. Apa sahaja akan dibalas dengan setimpal. Atau ia akan ditangguhkan ke akhirat mengikut pertimbangan Allah Taala.
Allah boleh buat apa sahaja. Moga kemerdekaan 51 Malaysia akan semakin gemilang dengan keharmonian yang kita usahakan tanpa mencetuskan hubungan tegang antara semua kaum dan bangsa yang berada di Malaysia.

Saya harap Datuk Seri bersabar…. kenapa mereka menyerang Datuk Seri begitu sekali…… dari mengacau isteri, kepada menghentak meja untuk kelulusan syarikat judi di Sabah.

In frustation ” Did the ACA upon obtaining evidence.., there is money… have to wait after the bye election (p44) is over before taking action?” says the ACA DG
” This investigation had been made in this 2 to 3 moths” says Hishamuddin.
” The facts of the case cannot just be simply made available… everything that we do will be a conspiracies to him(DSAI)” says Najib.
The above were the statements made in reference to the case of few exco from Perak who were remanded by the court to assist into investigation of alleged CBT case involving monetary and sex in exchange for a project in Sri Iskandar.
We, in my opinion must welcome and respect the ACA for their vigor and decisiveness in pursuing the case. Let the due process of law prevails. If the investigation proved the exco was guilty as alleged.., even if they were being set up.., we must have the courage to dispel them as they had breech the trust entrusted upon them by the rakyat.
After stating the above I wonder as to whether these whole episode was done in a manner up holding the impartiality of the ACA.
Whatever…. happens to the case of Dato Yong of SAPP from Sabah. Just following a day after he and his party proposed a no confidence vote to PM the ACA had issued an investigation papers. There was this guy from SAPP who is an MP had pleaded to PM to refrain from pursuing the case deem to have been a done in order to suppress the voice of discontent amongst BN??
The big question is ‘Is there any hidden hands.., either to shift the gear or to pull the hand brake in the prevailing circumstances???????? What was the status quo of the investigation that has been conducted over years? Did the ACA have to wait until the next turn of event which was detrimental to the ruling party??????????
This must be duly addressed by the ACA DG..
Is the whole machinery of nation building in this country under 22 4 years of BN ruling had been so corrupted that it is a norms to bribe to seal any project.
I would say…, lets change this menace once and for all. The spirit of awakening displayed on 8 of March must not stop. We must…, without any hesitation proceed to change the government. We will deal this ‘hantu’ amongst us later but the p44 must reflect change. We hope the permatang pauh voters to deliver us this crucial victory to Pakatan Rakyat.

Why? From the street police officer who accepts bribes for speeding through to the upper echelons of malaysian government, there is corruption. You can’t change this cancer… it is apart of Malaysian culture. Nothing was done to stop the spread. Corruption from an investment stand point is a risk.
Any risk can be measured. Investing in Malaysia is risky, so why invest in Malaysia when there are so many other SEAsian countries to choose from?
Sure there is corruption in the west, but none so deeply embedded in Malaysian society than now.
If you look at the degree of corruption in the police force and legal system, plus control of the media by the government you will see that you have no hope… only wishful thinking.
I do not understand the logic in Malaysia where Murder of a mongolian human being has less precedence than a case of sodomy. I would think that Murder would be a priority matter, but it seems that murder or terrorism for that fact in Malaysia isn’t a problem. Eating pork and not wearing a tudung seem to be more important issues….

SUDAH LAH HAMZAH Z……. bini sendiri pun nak jualkah demi karier politik kau….. Dah lah kena saman dulu oleh janda kau sebab kahwin yang ini……skrg nak jual maruah yang ini pulak kah? Yang ini kita semua kat ipoh kenal lah….engkau yang buta mata aja.Apa jenis manusia kau ini ah….sanggup jual maruah bini sendiri untuk posisi! Bini kau yang syok kat anwar kah, anwar nak gorat bini kau…..DSAI lebih handsome lah…itu sebab semua perempuan syok kat dia…nasib baik DSAI tak nak dia, kalau tidak telapas lagi lah engkau ni…faham. Sudahlah…pergilah buat duit banyak-banyak lagi kat FELCRA tu..ingat kita tak tahu kah….banyak kroni kau pakai no..kat situ…remember….kelapa sawit dealing.
Hai muncul balik si Hamzah ni dengan kisah fitnah basi 10 years ago. Aku masih ingat in 1998 bilamana si Rafidah bukan main serious cerita yang Hamzah menangis2 dok habaq kat dia yg isterinya main kayu tiga. Sempat pulak si Rafidah bagitau bagaimana dia memujuk Hamzah agar bersabar sambil akan bawa kes ini ke PM. Dlm skrip Rafidah masatu dia kata Hamzah mula mengadu kat timbalan menteri kpdnya masa tu iaitu Hisham. Banyaklah ko punya ceria rafidah oi, dah tentu Hamzah satu Perak ngan ko, apasal Hamzah nak cerita kat Hishamudin untuk disampaikan kat kau.
Hei Hamzah bangsat, since DSAI pun dah file saman ko sekarang, let see what you gonna to say in court and what evidence you want to table up. Kita cuba tengok adakah suara yg ko tapekan sedang bercakap dengan ‘gatal’ sekali tu with your wife is DSAI’s voice. Aku pun tak sabar nak tengok this showcase. Tak habis2 UMNO / BN nak pekenakan DSAI. Insya Allah kebenaran akan menghapuskan kebatilan. Aku dah tak sabar untuk ditadbir oleh kerajaan yang telus, adil dan mengamalkan syariat Islam.
Umno Perak should be ashamed by having too many leaders that can create big lies, seditious, slanderous etc for political survival. Please think aout tokoh2 Perak below:
1) Rafidah
2) Aziz Shamsudin
3) Megat Junid
4) Tajol Rosli (masa dia jadi timbalan Home Minister in 1998, boleh dia kata “…this is tip of iceberg…”, “…if we are in doubt go ack to rule number 1 i.e. te boss is always right (maknanya TDM always right lah”. And now Tajol dah pandai buat skrip sendiri dah at state level untuk rampas balik state government from PR.
5) Hamzah
Setotok pemimpin Umno Johor, taklah mereka ini menonjol dlm buat skrip2 fitnah ni. Cuma lately Hamid Albar lately lain mcm sikit. Bukan apa, sebab nampak muka pun mcm kaki ampu, bodek. Dulu bukan main nak cuba jatuhkan Muhyiddin dari Naib Presiden Umno..dia tak tau si Muhyiddin bukan hanya harapkan undi dari Johor but he got supports from the voters from others state as well.

Salam Perjuangan untuk DSAI. Ingin diucapkan Selamat Berjaya kepada Datuk Seri. Jangan bimbang. Senyapnye kami di Tawau dan rakan-rakan lain di Sabah bukan bererti kami lupa pada “ayah” yang satu ketika dahulu menyambut kelahiran, membesarkan dan mengasuh UMNO di sini. Diamnya kami bukan bermaksud kami menghindar dari perjuangan Datuk Seri. cukuplah sudah penderitaan yang kami lalui. Susu yang kami beri tidak rela dibalas tuba lagi. Kami berdoa agar Datuk Seri dipanjangkan usia menjadi penguasa i Putrajaya. Binalah kembali negara yang menuju kemusnahan ini.

P.s Salam untuk Datuk Seri dari rakan-rakan seperjuangan saya di Kapit, Belaga, Song, Bintulu, Sri Aman dan seluruh daerah dalam negeri Sarawak. Sudah sampai masanya negeri ini dibebaskan dari belenggu pemerintahan kuku besi.
