Radio Singapore International - Malaysia’s de facto opposition leader Anwar Ibrahim has demanded that the police drop the ongoing sodomy investigation against him.
This follows the emergence of a medical report that was done before the supposed second one which investigators have based their charge against Anwar on.
Malaysia’s Director-General of Health says the medical record that has been leaked should have been kept confidential.
And Home Minister Syed Hamid Albar is also calling for action to be taken against the person or persons who leaked the report.
Yvonne Gomez speaks to lawyer Sankara Nair, who is one of the members of Anwar’s legal team to find out if patient confidentiality rules apply when it comes to important evidence that can be used in a legal trial.
SN: The issue of the legality of the report or any information that comes to trial matters not because the Court, in the English system, unlike America, whatever that comes, even if it’s illegally obtained, can be admitted, if it is true.
How does this leaked medical examination record complicate the sodomy case against Anwar?
SN: It doesn’t complicate out case. It complicates the case for the possible prosecutors, because there is this evidence that has been available then itself, from the beginning, and it was not acted upon then, and then the investigation should’ve stopped because if at the first instance there is no evidence of sodomy, then why, in the first place, probe further, unless you are considering persecution, rather then prosecution.
The Health Ministry, however, has said that it stands by the findings of the other medical examination conducted by doctors from the Kuala Lumpur hospital. What happens in legal cases when two conflicting reports like this emerge?
SN: Clearly then, the benefit of the doubt must go to the accused, because that is, again, our system of English law that we practice in Malaysia. Whenever there is, even in a trial in a court of law in Malaysia, and in Commonwealth countries, evidence that is favouring the accused, then the benefit must be given to the accused. The benefit here, as I said, must go to the accused. So if there are conflicting reports which would then suggest that it would be unsafe, then the second report that’s going to be coming out, providing they are going to start prosecuting, will be rather suspect isn’t it? The result of which is that the court will always go in favour of the accused, you see?
As lawyers for Anwar, how would you and your team try to downplay the other report and call it that into question, if this goes to trial?
SN: We will obviously have to submit that there is, in the first instance, the police are investigating and then they come across a report which suggests that there’s no sodomy, and then comes a subsequent report. So we have to shoot holes into that report because why would the second report be then used for prosecution? It’s the motive that counts for a lot, doesn’t it? So that would be the main thrust of the argument. Secondly, we’ll obviously have to cross-examine very, very deeply into the fact of how the doctor submitted something new when it was not there in the first place. So there is a conflict and this is crucial evidence, you know?
Anwar has mentioned something about the authorities wanting to collect new DNA samples from him. Where does that fall into this investigation?
SN: Right now, from what we hear from the media, they are going to use the old samples. We’ve stated very clearly why we will not give it this time around because they already have the old samples. This has happened before in the earlier trial where we went through the whole process and we were going to debunk the DNA story and as soon as it was going to be evident, they withdrew the whole evidence and expunged it from the record. I was involved in the first trial itself and this being the trend, clearly we’ve advised out client not to give it.
What does the failure of the police to disclose this other medical report suggest for the bigger picture?
SN: This is where the conspiracy theory comes in. the police’s job is to investigate independently and neutrally and not to go in for prosecution. That should not be the attitude. If they see something that is in favour of the person they are investigating, they should then immediately call in the parties and say look, I think we can’t go further because this is in favour of the accused the A-G will then have to make a complete withdrawal of the whole matter.

I would like to write the following statements in the name of GOD whom I believe.
I am a goverment doctor in the rank of consultant working in hospital Kuala Lumpur. I know personally the doctors who examined Saiful on that day -28 June 2008.
The so called medical report mentioned in the NST is a fabrication or imagination by the UMNO paper. There is no such medical report submitted to the polis yet.
When examine Saiful, the specialist could not find any signs of Saiful being sodomised. Saiful was very cheerful, unlike real sodomised patient who will usaually very sad and disturbed.
Saiful was subsequently admitted to the ward and observed for a day. He was completely well in the ward and not emotionally disturbed.

Whatever happens, the raakyat is and should be with DSAI after reviewing the first case in 1998.
Those involved in 1998, is now worried that DSAI will go on a rampage and after them. I foresee them fleeing the country like how Marcos and his cronies did when his government fell.
Is AG sueing? Why not now and what is he waiting for, since IGP have started the ball rolling.
DSAI will win Kulim hands down as a martyr if he his detained and jailed this time around. The option is in his hands and better still if the dog (EMN) with six shoe boxes stand against him.

The burden of proof rests on the prosecution. The standard of proof is beyond a reasonable doubt. With the way things are, can anyone say that the case has any potential of being proved beyond a reasonable doubt?

Tahniah atas keberanian serta keikhlasan DSW memberi laluan kepada DSAI bertanding di Permatang
Pauh dalam masa yang terdekat ini. Dengan sokongan 100% parti komponen PR nanti saya percaya
pihak berkuasa pusat akan mengunakan taktik kotor BN dalam apa juga muslihat agar cita cita
saudara tidak menjadi realiti tapi pusat jangan lupa 6 buah negeri yang paling maju telah
PR takluki dengan sokongan rakyat sekarang ini.JGN LUPA KUASA DI TANGAN RAKYAT.
Saya menyokong kenyataan Dato’ Fauzi AR ( bekas MP )bahawa rata rata ahli UMNO sendiri tidak
berpuas hati atas layanan yang DSAI terima dari kerajaan pusat serta PM. Pada pandangan saya
UMNO sudah terkeluar dari agenda perjuangannya dan sudah patut berkubur semasa di istiharkan
haram oleh mahkamah tinggi satu masa dulu.
Saudara tidak akan keseorangan berjuang kerana rakyat Malaysia secara jelas telah menyokong
saudara sekarang. Percepatkan peralihan kuasa dan buktikan kepada rakyat khasnya bahawa apa
yang di perkatakan saudara bukan omongan kosong dan tolong ajarkan dan tunjukkan
jalan keluar buat penyanggak UMNO. Rakyat mahukan pepimpin dan perompak harta rakyat di adili
di mahkamah terbuka dan disiarkan secara ‘LIVE’ di kaca TV apabila PR memerintah nanti.

When the Pusrawi administrator said that Dr Mohamed Osman had just joined the hospital, I would have thought that this doctor was just a young punk just finishing his housemanship.
Thanks to Rocky Bru, a Mahathirian, he outlined the qualification and experience of the so-called GP who is not an expert. It seems that this Dr Mohamed had been in practice for the last 15 years.
Throughout my legal practice I have been defending more than 30 rape accuseds. The prosecution tendered the required medical report of the victims and as well as of the accuseds who examined by the GPs. Yet in this case a gp is described as if he was a nut by the administrator to be repeated by tv stations and the other media.
GP is a doctor, qualified and in this case a GP of 15 years experience, he is more than qualified to examine a case of sodomy. Medical reports tendered by gp of a few months practice had been accepted by court!
Ther is no case against Anwar when Dr Mohamed who examined this Saiful in the first instance concluded that there was no sodomy. Yes, there is no sodomy full stop. There shouldn’t be any prosecution, and if there is still be, then this is no more prosecution but persecution.

despite being far from Permatang Pauh, we’ll pray for your success to maintain the constituency.
We know DSAI will be able to do it again.
We always have faith in the Pakatan Rakyat’s party struggle and we hope the wicked/corrupt BN government can be toppled down the soonest possible.
After the victory in 5 states in Peninsula Malaysia during last election, the shock waves sent to Sarawak was just like a nightmare to Sarawak BN leaders.They have always thought that they were immortal and were still being complacent doing their dirty trick to cheat the rakyat. Those times have gone already, the rakyat now are already able to think maturely and no more “Burung Kakaktua” to BN leaders.Frankly, the BN leaders status are in bad shape now !!!!
BTW, just make sure that the SPR is doing their job FULL OF HONESTY this time.
Also, may we remind DSAI to be very careful of BN’s dirty tactics/tricks/stratecies in order to win EVERY ELECTIONS in the past. So this time, it may be even worse.

Rata rata rakyat tidak sabar menunggu siapa calon malang yang akan di ketengahkan oleh BN untuk
mencabar DS di P Pauh nanti.
Akhbar warwarkan mungkin bekas Imam masjid negara antara calon yg patut di beri peluang tapi
saranan saya agar Pegawai agama Umno ini lebih baik fokus untuk memberi ceramah agama dan
nasihat kepada Pemuda dan Puteri
agar mereka berjuang dan berpolitik dengan ikhlas atas landasan Islam sebenar. Jauhi rasuah,
menganyiaya, sombong,membunuh kerjaya orang lain dan memfitnah sesama insan.
Calon yang paling sesuai adalah AP Kepala Batas sendiri mencabar Ketua Umum Keadilan ini.
AP Kepala Batas ini pernah kata siapa DSAI ini sebelum PR-12 dulu dan ada baiknya beliau dapat
bertemu dan berkenalan siapa DSAI lebih dekat. Masa yang paling sesuai AP Kepala batas ini
membersihkan nama baik beliau sebagai PM dari negeri yang kalah dalam PR umum lalu.
Itu pun kalau AP Kepala batas cukup bersedia ini lah bertarung.
Bagi pemimpin Umno yang lain nya tak usah lah kerana ada yang berbuih lagi mulut.
Jangan anyiaya diri sendiri.
PDRM pula diperlukan ramai anggota untuk mengawal keadaan kerana takut samseng akan membuat
kacau. Siapa SAMSENG yang dimaksudkan Menteri dalam negeri ini? Penyokong BN sendiri atau
P Rakyat?
Bagi kerajaan P Pinang dan penguasa hotel bersiap sedialah kerana ini adalah Tahun Melawat
Malaysia dan P Pinang. Bayangkan wang yang akan disalurkan oleh Umno untuk PR kecil ini dan
seluruh dunia akan memberi fokus kepada P Pinang nanti.
Pengundi P Pauh…Anda tahu menilai dan kuasa adalah ditangan anda dan guna sebaik mungkin.
Lihatlah segala projek kerajaan Pusat sudah dibatalkan oleh
AP Kepala Batas sendiri oleh kerana P Pinang diperintah oleh P Rakyat.
Rakyat akan tetap bersama DSAI. Percayalah…….. LAWANNNNN TETAP LAWANNNNN
