Virtually the whole of Malaysia is now talking about DNA. DNA (Deoxyribonucleic Acid) has become a buzz word, featuring in conversations at coffee shops; offices and even our august parliament.
We must thank Crick and Watson who discovered the double stranded helical structure of the DNA molecule in 1954 which has since unleashed a plethora of advances in biotechnology. Forensic DNA is one of the many breakthroughs in this research in an impassioned endeavor towards advancing justice through DNA technology.
Justice and fairness should instead be the buzz word of the rakyat, the parliament , political leadership and the impartial media. This unfortunately is a far cry considering the various statements issued and the nuances of the mainstream media. Overnight, a handful of parliamentarians have turned pseudo-geneticists, shouting for surrender of DNA material ! Some have even sentenced the alleged assailant an unequivocal guilty verdict!
Beginning with the end, it is important to emphasize upfront that with all of the available DNA techniques, conviction cannot be based on DNA evidence ALONE if there are a host of other conflicting and non-corroborative evidence. For example, if a victim claimed rape in a condominium in KL whilst the accused was addressing a seminar in Singapore at the material time, no amount of DNA recovered at the crime scene is going to make any difference.
We hope this would moderate the DNA mania which is incessantly hyped, the latest by the father of the alleged victim.
Notwithstanding, what is worrying from the hypothetical case scenario is, how DNA of the alleged assailant got into the condominium. In the language of forensic medicine, there is an outright breach of the chain of custody in this hypothetical case.
Surrendering blood for DNA testing is NOT the central issue in the current stalemate. Maintaining the chain of custody is the CRITICAL factor for any DNA evidence. It demands a strict record of individuals who have had physical possession of the evidence and the process used to maintain and document the chronological history of the evidence. The chain of custody of the specimens must be strictly guarded to ensure the collection, delivery, testing, storage and rigorous documentation of the results are preserved and protected from any unauthorized and illegal access.
The historic trial of 1998 laid bare the extreme flaws of the country’s DNA squad, by design or otherwise. The grave concern from all quarters, national and international on the conduct of the current investigation is understandable and reasonable given the experience we were subjected to the last time this play was enacted. The accused and family who endured those humiliating moments of the last sham trial must be gutted by this sequelae.
We offer below a short brief on DNA as an idiots guide to the correct medical procedures to be followed in cases of alleged sodomy. It is grounded on back to basics forensic medicine, founded on evidence and not emotions.
1) If the alleged victim claimed “the latest violation” on 26th June 08, had “counsel on 27th June 08 and reported to police on 28th June 08, it is highly likely that nature’s most efficient plumbing system would have flushed out whatever foreign fluids and tissue deposited within that most currently spoken of orifice. Almost all humans need to answer the big call at least once a day!
2) Notwithstanding the above, if indeed the alleged accused’s specimen was obtained from the “hole”, it would be imperative to verify the authenticity of the collection to ensure no foul play was involved in collecting the specimen.
3) DNA from the sample obtained in (2) can then be readily compared with the DNA fingerprint of the accused, assuming his DNA profile from the last trial had been safely archived. That is the role of the National DNA Database. It is hence nonsensical for the incessant calls for the accused to give his fresh blood to perform a match with the sample from (2). Unless of course in typical Malaysia Bolehland fashion, the accused’s DNA fingerprint records have gone missing! This then does not speak well of the professionalism of the investigating team. But then again it is but a recurring theme in so many other investigations of late.
4) The prime minister and the deputy IGP, amongst others have insinuated that old DNA from 10 years ago is of little or no use in the current saga. Let it be known by all and sundry that there is no expiry of DNA. For purposes of DNA fingerprinting alone, even the Jurassic dinosaurs DNA can be analyzed, unless of course there is a sinister intention for use of the accused’s fresh DNA that is almost unthinkable.
We offer the following solution to the current impasse for the authorities kind consideration :
If at all it is legally required for the DNA of the accused to be analyzed from a fresh blood sample, the following is the recommended procedure.
There must be three specimens
a. Blood from the accused
b. Blood from the alleged victim
c. Specimen from the “hole”
There must be two aliquots (portions) of each specimen and these must be presented concurrently to prevent any tampering by either or both parties. The chain of custody of the specimens must be strictly adhered.
DNA analysis of the three specimens can then be conducted independently by a laboratory of their choice (both parties getting 1 aliquot of each specimen). A holding watch of each process can be agreed upon.
DNA matching from the above can then be used as corroborative evidence to either acquit or convict. DNA does not lie provided humans handling them don’t.
As all Malaysian citizens would have realized by now, politics and medicine is a very volatile mix. The political sodomy of medicine in the trial of 1998 should make all of us even more wary of the innuendos which the current saga brings to fore.. This, despite the exclusion of the IGP and AG from the investigating and prosecuting teams and all the assurances from the powers that be.
The Malaysian public in particular and interested parties around the world awaits the truth of the matter in this episode of “Sodomy Malaysian Style”. We pray that this time around truth will not be sacrificed at the altar of political gamesmanship!

Dato’ Dr. Musa Mohd. Nordin obtained his MBBCh from Cardiff (UK) and the MRCP (UK). I am now facing one sedition charge and three criminal defamation charges. They say Muslims are allowed four and I have just reached my limit of four. Nevertheless, my great-grandfather, Sultan Ala’eddin Suleiman Shah, the Fifth Sultan of Selangor, had ten wives. He also had 44 children from these ten wives, my grandmother, Tengku Badariah, being one of those 44. Needless to say, with the track record set by my great-grandfather, would I be satisfied with stopping at just four? Certainly not! And, today, I am going to chalk up my fifth ‘criminal charge’, whatever that charge is going to be.
Today, in the spirit of my fifth criminal charge, I am going to make another ‘seditious’ or ‘criminal defamation’ allegation against Deputy Prime Minister Najib Tun Razak, in the spirit of what Anwar Ibrahim said to CNN last week (see the CNN report here: http://72.47.236.85/2008/content/view/10077/1/ ). And this allegation is that Najib met Saiful to discuss the sodomy allegation against Anwar and for no other reason other than that — and certainly not to discuss the young man’s future career or scholarship.
This time I am going for broke. This time I am prepared to go to jail for a long, long time just to make sure that Najib is not going to become Prime Minister of Malaysia in June 2010. Yes, I know I am headed for a fall, but I am going to bring Najib down with me. We shall both hit the dirt and become history, side-by-side.
And how will that happen? Well, this time I video-recorded a ‘confession’ session. And the video recording is now in a safe place, ready to surface during my trial when they charge me for this newest ‘crime’, whatever that crime is going to be.
The gist is as follows. When Saiful went to meet Najib, he brought a friend along. And this friend has confessed to the entire thing in a video recording, which I now have in my possession. So bring it on. Give me all you’ve got. Charge me and let us see what happens in court.
Yes, Najib met Saiful to discuss how to fix Anwar on a sodomy allegation. No doubt, at first Najib denied all this. At first he said he never met Saiful, not even once in his life. Then he admitted meeting Saiful but said he met Saiful to offer the young man ‘career guidance’ and to discuss his future, scholarship, and all such matters. The first statement was a lie. The second was also a lie. Najib met Saiful to discuss the sodomy allegation against Anwar.
If Najib can lie so many times with regards to his meeting with Saiful, would he not also be capable of lying about never meeting or knowing Altantuya? What would Najib say if during my trial I adduce a military intelligence report dated when Altantuya was still alive which confirms that he was involved romantically (or ‘involved sexually’ would probably be the more appropriate word to use) with Altantuya?
Sure, charge me. Put me on trial. Even obtain a conviction and send me to jail if you wish. Hey, I am 58. By the time I go to jail I would probably be 60, if I happen to still be around and not already dead by then. So, you can send me to jail, but for how long? What difference does it make when I am no longer alive anyway? And I really don’t expect to live to a ripe old age of 83 like Tun Dr Mahathir Mohamad. Najib, however, will never become Prime Minister in June 2010. And that is worth going to jail for, however long the sentence may be.

Then, if the police charge you for anything, we will be reveal this tape to prove that what you told the police under duress is different from what you said tonight. That is why you must speak naturally and not look stiff or like you are being forced to say whatever you are going to saying. This video recording is for your protection to ensure that they will not arrest you and force you to make any statement that is not true.â€
“Okay.â€
“Let me know when you are ready. Drink some water to clear your throat and finish your cigarette first. Then we will start. Be comfortable and don’t worry. No need to even look at the camera if that makes you uncomfortable. Speak to me. Look at me and talk. It is easier when you speak to a person than to the camera.â€
Sessions starts and he relates his story. After 15 minutes he gestures for the camera to be switched off and I oblige.
“I am not sure whether I want this next part recorded on camera.â€
“Never mind. We can record it anyway and then if you feel it is damaging it need never surface.â€
“I would rather get my lawyer’s advice first before this second part is recorded because it implicates Najib in the sodomy allegation against Anwar.â€
“Okay, we can leave the camera off and you can relate the second part off-camera. Then we decide later if it should be recorded or not.â€
“This second part is about our meeting with Najib.â€
“Oh, you also went to see Najib?â€
“Actually, I did not know why we were going to see Najib. Saiful just said that he wanted to go and see Najib and he wanted me to follow him. So I followed him. I was present when Saiful discussed with Najib about the sodomy allegation against Anwar. I did not know he was going to see Najib about that.â€

1998 was the year that opened these eyes to our embarrassing political scene. I was merely 12 at the time, however, by reading, mixing and speaking to a lot of older people, I grew fond of politics instantly and I knew then what I should be considering to make my own judgment in the future.
10 years have gone by, I would like to express that I may be a 22-year-old child, and I may not be the most political youngster at my age, nonetheless, what has been presented before my eyes on this space has been foreseen on my mind for quite awhile. Now, as an aspiring journalism student and a journalist myself, I find it more educative to be reading journals as the media is being controlled by the government and can be biased, without a doubt (newspapers etc). This doesn’t mean I do not read the newspapers. As I’d like to put it, I love knowing the two sides of a story and from there, you make your own out of everything. Not forgetting, I would like to congratulate you by “combating” with points and facts in the debate with Shaberi. I too feel sorry at the same time that instead of answering your questions which are full with sharp, crystal clear points, Shaberi just had to make a personal attack towards you. At times I wonder, they (you know who) urge us to move forward but at the same time, why is this sodomy accusations are still being brought forward? Why now? I thought we were supposed to move forward? And unity? Look at UMNO itself. I think some people should just stop pointing fingers at others because the remaining four fingers are pointing back to themselves.
I once thought to myself that I could be wrong by thinking the DNA that has been obtained by the authorities shouldn’t be replaced by a new one as it is not necessary, to my diminutive point of view that is (the dinosaurs example is astonishingly brilliant). By reading the detailed information, Alhamdulillah, I am proud that I thought right all these while.

There is a BIG VERY BIG difference if Pakatan and DSAI comes to power vs the current BeeEnd power structure and you should highlight it in your blog.
If DSAI ever comes to power, people should not worry, because DAP and PAS comes to power also as EQUAL partners. Lim Kit Siang and Tok Guru will not just let DSAI do as he wants.
This will truly be a check and balance govt. Likewise , PAS cant do as they want without angering DAP and also DAP cant do as they want without angering PAS. Because if any of the 3 walks out of Pakatan, Pakatan Rakyat will fall as the Govt. So , all 3 parties work together!…No one single party can call the shots, ie PAS cant simply ‘impose’ the Islamic state concept without DAP agreeing…………DAP cant simply take away the constituionally protected ’special rights’ without PAS agreeing…..and finally DSAI cant do as and what he pleases without Lim Kit Siang and Hadi Awang in concurrence….becoz with Pakatan Rakyat, any of the 3 walking away, they will fall!……………that is REAL check and balance and a true coalition

Please don’t give them any fresh blood sample. It is clear that the police have so little evidence against you that DNA will be the MAIN, not corroborative evidence. They desperately need to fabricate this ‘evidence’ or the case is nothing.
However I note that Syed Hamid is going to rush through legislation in Parliament in Aug to compel suspects to provide samples for DNA testing. That’s how desperate they are.
Does Dato’ Seri have any plans to counter this? Perhaps your blood sample can be marked with some form of chemical tracer so that its origin can be traced.
Even a kangaroo court needs something to work on. Don’t hand them that something.

Today Malaysia is still a backward country judging from its police, judiciaries, citizens’ human rights and citizens’ awareness. Malaysians, you are partially blamed for these.

Why not you rise together with all the righteous people neighbourhood to say a BIG NO to the hooligans???
