Semasa Perdana Menteri Abdullah Ahmad Badawi memulakan jawatannya pada 2004, dia telah disambut sebagai seorang pengubah yang akan menyuburkan kebebasan demokrasi di Malaysia. Kelmarin, kerajaan beliau telah menyuburkan kembali Akta Keselamatan Dalam Negeri (ISA), satu undang-undang peninggalan penjajah dahulu yang memberikan kuasa mutlak kepada Eksekutif untuk menahan pihak penentangnya. Tindakan tersebut mencetuskan persoalan serius tentang iltizam Abdullah terhadap demokrasi.
Malaysia sedang berdepan dengan krisis politik yang paling besar sejak 1998, ketika mantan Timbalan Perdana Menteri Anwar Ibrahim, mengepalai pergerakan Reformasi. Sejak November, sekitar 30,000 orang telah bersatu melaungkan agar diadakan perubahan kepada sistem pilihan raya, lebih 20,000 orang etnik India telah membantah terhadap perbezaan ekonomi dan para peguam telah turun ke jalan raya tunjuk perasaan menentang rasuah penghakiman. Protes yang sama telah diadakan lebih awal pada minggu ini.
Pada mulanya Abdullah menyahut cabaran secara bertahan, meminta para pembantah supaya duduk di rumah. Polis juga menolak setiap permohonan mahukan permit membantah, dengan alasan mahu mengekalkan perpaduan rakyat. (Di Malaysia, walaupun Perlembagaan membenarkan hak berkumpul secara aman, mana-mana kumpulan yang berkumpul lebih daripada lima orang mesti terlebih dahulu mendapatkan satu permit).
Apabila tindakan ini tidak berhasil, Abdullah mengambil satu cara kekerasan yang pernah diamalkan oleh bekas ketuanya dahulu, Mahathir Mohamad, dengan memperlekeh pembangkang politik. Kelmarin, aktivis India yang turut serta dalam perhimpunan aman pada 25 November, telah ditahan di bawah ISA. “Mereka boleh ditahan selama dua tahun kerana menghasut dan menjalankan aktiviti yang mengancam keselamatan nasional,†demikian kata Johari Baharom, Timbalan Menteri Keselamatan Dalam Negeri kepada Bernama. Beliau tidak menjelaskan bagaimana satu himpunan aman boleh “mengancam keselamatan negara.â€Â
Abdullah memang sudah lama berdepan dengan ledakan itu sepanjang minggu. Pada hari Ahad, satu kumpulan peguam dan aktivis – termasuk penggerak utama yang melancarkan bantahan yang paling besar bulan lalu – telah ditangkap, dan dibebaskan kemudiannya. Pada hari Selasa, beberapa orang pemimpin parti pembangkang telah dipenjarakan. Segelintirnya – walaupun bukan semuanya – sudahpun dibebaskan dengan ikat jamin. Ada yang tidak pun didakwa. Akan tetapi mesejnya amat jelas: Sesiapa yang mengkritik kerajaan sebelum pilihan raya umum yang akan diadakan, mengikut jangkaannya pada awal tahun hadapan, ataupun mendesak agar proses pilihan raya dibersihkan, boleh disumbat dalam penjara.
Tindakan keras beliau sesungguhnya memburukkan keadaan Abdullah. Rakyat Malaysia bukannya mempunyai kebebasan bersuara yang sama dengan negara demokrasi yang lain. Pihak media memang begitu dipengaruhi oleh kerajaan. Jadi, salah satu daripada segelintir cara untuk ahli politik pihak pembangkang dan aktivis menyuarakan rintihan ialah keluar di jalan raya. Dengan menafikan hak itu, Abdullah sebenarnya mencabar kumpulan tersebut menganjurkan bantahan orang ramai yang lebih besar lagi.
Rakyat Malaysia memang tidak suka dengan bantahan ganas di jalan raya. Seperti yang pernah dilalui oleh negara ini pada 1969 dahulu, ketika beratus-ratus orang telah terbunuh dalam rusuhan antara orang Melayu dan Cina. Akan tetapi dalam sebuah negara demokrasi yang matang, tidak ada sebab kenapa rakyat Malaysia, tidak boleh dipercayai mengadakan debat aman mengenai masa depan politik mereka. Cara Abdullah menangani protes masa depan akan menentukan hala tuju demokrasi Malaysia. Kalau diambil kira tindakan semalam, pertandanya memang tidak bagus.
When Prime Minister Abdullah Badawi took office in 2004, he was welcomed as a modernizer who would expand democratic freedoms in Malaysia. Yesterday, his government resurrected the Internal Security Act, a colonial-era law that gives the executive almost unlimited power to detain opponents. The move raises serious questions about Mr. Abdullah’s commitment to democracy.
Malaysia is facing its biggest political crisis since 1998, when former Deputy Prime Minister Anwar Ibrahim led the Reformasi movement. Since November, around 30,000 people have rallied for electoral reform, more than 20,000 ethnic Indians have protested against economic discrimination, and lawyers have marched against judicial corruption. Smaller protests were held earlier this week.
Mr. Abdullah first responded defensively, calling on the protestors to stay at home. The police also denied every request for protest permits, under the guise of protecting public safety. (In Malaysia, even though the constitution protects the right to peaceable assembly, any group exceeding five people must obtain a permit to gather.)
When those measures didn’t work, Mr. Abdullah adopted the tough tack of his predecessor, Mahathir Mohamad, by intimidating his political opposition. Yesterday, five Indian activists who participated in a largely peaceful Nov. 25 rally were detained under the Internal Security Act. “They can be held for two years for sedition and also for carrying out activities that threaten national security,” Deputy Internal Security Minister Johari Baharom told state news agency Bernama. He did not explain how a peaceful protest can “threaten national security.”
Mr. Abdullah had been building up to this bombshell all week. On Sunday, a group of lawyers and activists — including those key to organizing last month’s big protests — were arrested, then released. On Tuesday, several opposition political leaders were jailed. Some — though not all — are now out on bail. Some were not even charged, but the message was clear: Criticize the government in advance of the general election expected for early next year, or demand that the electoral process be cleaned up, and you can expect to end up in jail.
By wielding a tough hand, Mr. Abdullah is aggravating the situation. Malaysians don’t enjoy the same freedom of speech that other democratic nations enjoy. The press is heavily influenced by government. So one of the few ways for opposition politicians and activists to air their grievances is to get out onto the streets. By denying that right, Mr. Abdullah is challenging the groups to organize bigger rallies.
There’s no appetite in Malaysia for violent street protests like the ones the country suffered in 1969, when hundreds were killed in rioting between Malays and ethnic Chinese. But equally, in a mature democracy, there’s no reason that Malaysians can’t be trusted to have peaceable debates about their political future. Mr. Abdullah’s handling of the next round of protests will say much about where Malaysia’s democracy is headed. Given yesterday’s move, the signs aren’t good.









Mr Anwar, this is my final response to your column as I wish to make way for others to contribute opinions that might pave the way to a more harmonious and peaceful co-existance. All great thinkers, educationists and philosophers of our times call and advocate for the freedom of expression within the limitations of liberty laid out by a just and fair ruling body. I feel Malaysians should be given that much of freedom of expression, for ABSOLUTE POWER CORRUPTS ABSOLUTELY and ONE CAN FOOL ALL THE PEOPLE SOME OF THE TIME

Today, we need a lot of common sense, analytical and critical thinking, diplomacy and last but not the least positive criticism invoked to create and maintain a harmonious, well balanced, productive and developed society.The govt. in no way, can point a finger at anyone else but to itself when there is dissent and crisis.

THE PHOENIX RISES (Part 2)
I wish to be fair to Dr. Dato Anwar Ibrahim and I wish to state very clearly that I DO NOT REPRESENT HIS OPINION; and that he does not know me in any capacity. I speak for myself and I hope to offer our Chinese brothers in Malaysia some useful opinions to advance the communal interests of our Chinese brothers.
I see Dato Anwar as a saviour for our Chinese & Indian brothers; I see a partnership between Dato Anwar and our Chinese & Indians as an opportunity for our people to break the iron grip of UMNO on restricting the advancement of our people. By my strategy of rallying our Chinese brothers to vote for the opposition, we Chinese can improve our standing in the political environment in Malaysia and we do not need any favours from either UMNO or even Dato Seri Anwar; we stand alone and by our own strength, and if the opposition will join with us we welcome it and with a Malay Prime Minister at the head, we can both progress together in fairness and with justice. WE JUST DO NOT NEED ANY SUPPORT OR PATRONAGE FROM UMNO OR EVEN KEADILAN; and that is the beauty of my strategy; and I can say for the first time in 50 years of Merdeka, we can really achieve a just SOCIETY THAT IS LAW BASED AND GOVERNED BY LAW AND NOT BY CORRUPT JUDGES WHO DO NOT KNOW THE LAW.
The Chinese & Indians do not need corrupt leaders and today’s MCA & MIC leaders are incredibly corrupt and we therefore REJECT THEM ALL. Let us Chinese & Indians look to ourselves for guidance, we decide for ourselves what is good for us and not be influenced by such dirty politicians as that Samy Velloo & that OKT fellow; we do not want to let them draw strength from our voting right. We need to abandon this Samy Velloo fellow; he is the face of the arch Indian traitor, who will sell his wife to retain his position in the BN. TIME TO GO SAMY VELLOO !
I am posting this second part of my 5 part article this morning because I had just (2nd of Feb., ’08) watched on Al Jazeera TV a discussion coming from their Washington station on this very subject of my discussion ie. The “LATINO†community aggregating the power of their LATINO VOTE in this year’s USA Presidential election and the effect and power of their vote as a community. I find this discussion valuable because the situation that the “LATINO†face is the same as that faced by our Chinese & Indian brothers in Malaysia. The Latino are quite often illegal immigrants ( a worse situation than our Chinese people in Malaysia because in Malaysia, Chinese & Indians are at least citizens, and the Latino is usually not). The lesson that we wish to point out is that in California the Latino vote has become the deciding “swinging voteâ€Â; this is also the position that I am asking our Chinese & Indians to wrest and hold and control in their own hands. It is important that we do not surrender our voting power en bloc to the treachery of those scoundrels in both the MIC & MCA, because if we look to their leadership then we will have surrendered our last hope to gain equal citizenship to these very scoundrels who bargained away our rights to the Malays for their own aggrandizement.
Coming back to my original discussion, the Latino vote today is wielded like a sword in California, the state that has the biggest population; they have put the main stream WHITES INTO SECONDARY POSITION because the whites are quite evenly divided into DEMOCRACTS AND REPUBLICANS; and the Latino vote although smaller is THE SWINGING VOTE between the two main parties. The Latino do not belong to any particular party AND THAT IS THE IMPORATNT STRATEGY, that we do not belong to either the MCA or the MIC and we vote guided by our own requirement and our own needs; and in Malaysia we Chinese & Indians want equal rights to citizenship and we do not want to be second class citizenship. THIS MY BROTHERS BOTH INDIANS & CHINESE IS VERY DEFINITELY WITHIN OUR REACH. Do what I recommend just for once and watch what effect it will have to change for the better our status as Malaysians. The beauty of my strategy is that we must not vote as member of the MIC or MCA, we vote for ourselves and guided by our own demands. I say to all my brothers in the MIC & MCA to reject their evil and selfish hold on your destiny and ignore those who approach you for your vote. Spit on their faces and vote opposition.

The continued existence of UMNO, MIC and MCA are the natural “barrier†blocks to the assimilation and natural union of all Malaysians into one modern nation that find commonality as the glue of shared values rather than as separating walls that divide our respective races. Malaysia today is the same Malaysia as in 1957, the first days of Merdeka. Unlike most nations that have progressed and become ONE PEOPLE since becoming independent from their colonial masters, Malaysia today is still disparate and sectarian and consequently Malaysia is a weak third world and backward nation of a post colonial era, and to illustrate my point there is no escaping from a comparison with what Singapore has become with what Malaysia is today. Yes ! it hurts for you Malays to compare Malaysia with the transformation of Singapore and their achievements. It will not be too remote to say that Singapore exist in a different dimension altogether when Malaysia is compared to her and her people. Malaysia today is 28 million people and Singapore has a population of 4.5 million; will it be too hurtful if I say that the per capita income of Singapore is higher than that of
Australia’s ?
In a lecture given by MM Lee Kuan Yew to a business conference dinner in DOHA( I think it was DOHA) Mr Lee was asked what to his thinking was the key to the tremendous leap of success achieved by Singapore in such a short time ? His reply was unabashedly and very matter of fact said, he attributed Singapore’s success to the CHINESE AND THE INDIANS. This lecture was reported in the Straits Times (Singapore’s of course) just about a week ago, and if you are quick enough you can still read it on the internet. I am not a Malaysian any longer and I will say what is the truth. To the Malays, I say look at what you as a PERSON HAVE ACHIEVED, IN THE ENVIRONMENT THAT YOU LIVE IN, IN THE SO CALLED AFFIRMATIVE SUPPORT THAT MALAYSIA SO NOTORIOUSLY ENTRENCHED. Do not hide your head in the sand as you are wont to do, but to be honest to yourself and really look at yourself critically, WHAT HAVE YOU AS A PERSON WITH THE CRUTCH OF AFFIRMATIVE ACTION.ACHIEVED IN TRUTH. To cut to the chase, so to speak, the Malaysian affirmative action spent billions of ringgit to produce a large class of privileged BUREAUCRATS, because most of those who hold degrees are trained in disciplines that have no practical APPLICATION, as for example in areas mostly in the arts or they were graduated below acceptable academic standards. Yes ! you can go on and protest all you like but we all know don’t we ? It is also the truth that most Malays do not find the study of science & Math. Easy and that is one reason why very few Malays pursue a course in science. In the modern world for a nation to progress, they must produce a large & ready pool of technocrats trained in the sciences; but in Malaysia these technocrats are as rare as whales tooth.
On the other hand the Chinese & Indians take to science and engineering as natural as ducks to water and it is this pool of talents that Australia too is too short of for the booming mining industry fueled by the insatiable demand for mineral resources by the people’s Republic of China. I say to our Chinese & Indian brothers who are engineers and professionally trained to emigrate to Australia; but if you choose to stay then it is mandatory that you must promote change in the Malaysian environment. Our young Indians & Chinese brother must realize that it is the sacrifice of their parents that made it possible for them to pursue their course of study and for them to earn enough to pay off their upkeep while they studied they need to find employment that will be sufficient for them to repay their debt. In Australia the average income for a first degree in his first year of employment is AUD35,000/ year; that will be equivalent to ringgit 100,000/ year. In Malaysia, I believe the first year pays you only a monthly salary of about RM1,500; and that will only give you RM18,000/year, hardly enough for a person to live on his own. Many Malaysian families have skimed to put their children through an Australian school so that upon graduation and after 1 year at work in the country of your origin, you become eligible to apply for permanent residence in Australia.
For the past 40 years, UMNO was the natural Malay party that can form government, because under the Malaysian Constitution, the Prime Minister has to be a MALAY. While the PMIP (Pas known then) was a Malay Party, because it was religious based, they were unable to appeal for support from the non-Malays. There was gridlock in this sense and this went on until the falling out of Dato Seri Anwar with TUN Mahatir; and this falling out created opportunity FOR AN ALTERNATIVE OPPOSITION PARTY THAT CAN ALSO FORM GOVERNMENT UNDER THE CONSTITUTION. To say the least, the existence of Party Keadilan plus DAP plus PAS is a “mirror†image of the Barisan National Party; essentially the opposition too is in composition essentially similar to that of the BN; except for one very big difference, Party Keadilan means “JUSTICE†in Bahasa; the JUSTICE PARTY. This is the big difference from my perspective, and a difference with great positive possibilities for the progress & advancement of Malaysia.
Let us bear in mind that MCA, MIC and UMNO are all race based party that were formed as an expediency, because the British colonial masters were in a hurry to depart Malaya and end their imperial status. However, at the crucial time of these events, the Chinese were represented by a damned “BABA†in the person of Tun Tan Cheng Lock, who was in a cultural sense a damned Malayu. He was a BABA who inherited great wealth, and what does he know about politics; while on the Malay side they had the amiable “Tengku†who came from the Royal family of Kedah, and of course he being a Prince took to politics as duck to water. Today the Chinese are stuck to the “non-performance of Tun Tan Cheng Lock; because Tun Tan did not fully appreciate the long term consequences of the Malay privilege clause; so to cut a long story short we Chinese are stuck with this insanity of the special privileges of the Malays. You can say that we Chinese are fucked by the accident of omission; change must come to remove the stain of permanent second class citizenship.
In a modern day Malaysia, the continued existence of MIC, MCA and UMNO are anachronistic, they are the relic of colonialism and they serve as weapons in the hands of political hacks who would exploit their divisiveness to gain an advantage. Therefore all the components of the BN. Need to be replaced by more modern and more realistic political institutions THAT CUTS ACROSS RACE DIVIDES and to this extent, I had earlier said that Keadilan Party serves this purpose snugly. Please bear in mind that so long as UMNO, MIC and MCA exist our Malaysian society will remain divided because Chinese can only support Chinese, Indians can only support Indians and Malays can only support. Yes, I understand that Indian can vote Chinese, but bear in mind that for those in the rural constituency being member of MIC makes the voter think he is obliged to vote Indian, and so too for the Chinese & Malays. CAMPAIGN FOR CHINESE & INDIANS NOT TO VOTE FOR
MCA , MIC AND GERAKAN
I call on my Chinese and Indian brothers NOT TO VOTE FOR MCA MIC AND GERAKAN, because a vote to any of these bloodsuckers is a vote for UMNO. We have lived under the UMNO government for more than 50 years and in that time we Chinese & Indians were led by those MCA, MIC & Gerakan traitors to our people. Malaysia today is the same Malaysia of 50 years ago; Malaysia is still RACE BASED and Chinese & Indians are at the rock bottom of the pile; we do not want to be the “sidekick†of UMNO. Chinese & Indians have been sold out to UMNO just so that a few political charlatan in MCA can become MINISTER and in MIC, this Samy Velloo has been “MENTRI†for 30 years and he has become rich, while other Indians can hardly make ends meed.
There is a myth that our Chinese can do well in Bussiness, but that is only possible if Chinese are allowed to function in an environment of the level playing field, but Chinese people must admit to themselves that we Chinese are no miracle worker. We cannot do well if we are prohibited from operating fairly; AND UNDER THE DOMINATION AND OPPRESSION OF UMNO, we Chinese & Indians are deprived of the simple opportunity to operate.
UMNO has become a Malay Masonic lodge of a small group of very privileged Malays who think nothing of corrupting the system to enrich themselves. I say to our Chinese & Indian comrades NOT VOTE MCA, MIC & GERAKAN because a vote to them is a vote for UMNO. The curse of UMNO has to be broken. UMNO is the DAM WALL that holds up progress of all Malaysians to wards a UNITED MALAYSIA of one people. This is the year when UMNO is led by a Prime Minister who sleeps at Parliamentary Sessions and this is the year that UMNO can be broken. I say to all our Chinese & Indian comrades to UNITE, and I say to those who would lead Chinese & Indians not to fight over “SEATS and for them not to seek “PANKAT†( high social status ).
I read in this morning’s STAR.COM.MY a very powerful article written by a Malay (forget his name) and he argues along the same lines as I have argued in my blog at http://yapchongyee.blogspot.com, that our entire focus ought to be directed towards defeating UMNO in all ways that we can think of because it is UMNO that seeks to dominate and hold dictatorship over the Chinese & Indians. We need to concentrate all our efforts towards support of PAS, DAP and Keadilan. I have even gone to propose that dato Seri be the “OPPOSITION†SUPREMOE so that any overly ambitious persons who only wants “pankat†will be eliminated. Dato Seri must be trusted to DICTATE who is the most likely to win election for the constituency. Do not fight for “seatsâ€Â. We are most interested to gain a FREE & JUST MALAYSIA FOR ALL MALAYSIANS AS ONE PEOPLE. To achieve this noble objective we need to OBLITERATE UMNO; a party that has for too long brought nothing but hardship to all Chinese & Indians. This fact is also known among Malays who do not have strong connection to powerful members of UMNO. Ordinary Malays do not get privileges; only those who have connection enjoy opportunities.
The first task for any new government that comes in on the ouster of the UMNO government IS TO REFORM THE JUDICIARY, so that Judges will enforce and faithfully apply the existing laws and not pervert the course of justice, as has been done today. Malaysia has a broken down 3rd rate and 3rd class, 3rd world judiciary; this is a pity because in the old days we could reply on our judiciary to deliver a just outcome, but not any more in todays Malaysia. There are several cases when Judges are found not to apply the law as they are obliged to do; but instead to act so obviously out side the law to achieve an agenda that is purely selfish and personal either for corrupt personal gain or to achieve what the government wants. I have written so many comments about the but it has gone unheard. It is indeed regrettable that those who destroy the judiciary, do not ven stop to think that when one has CONNECTION ONE GETS ONE’S WAY by perverting the law; but then they who do these perversion of the law do not bother to think that why they are out of office, the injustice and hardship may fall on them who subvert the professionalism and ethical conduct of the judges. A good example is that of Tun Mahatir, He has retired but a god will have it Tun Mahatir is working “over-drive†to GAIN JUSTICE AND THE RULE OF LAW, the sanctity of the rule of law, that he had subverted himself when he was PM.

This post is to advertise my next coming posts, which I am privileged to write as an Australian, because if I remained a Malaysian I WILL SURELY BE DETAINED UNDER THE “ISAâ€Â. In this respect, I want to credit the efforts of China Peng and his nationalist movement that forced the BRITISH IMPERIALIST to withdraw and hand independence back to MALAYSIANS.
I will post this article in my own blog at http://yapchongyee.blogspot.com. I will do this because I am certain that Dato Seri Anwar does not and will not share my point of view. I will post this article on the 15th of Feb., I can assure all UMNO members that they will not like what I am about to say. On the other hand my article argues the case that MCA was intended by both the UMNO and the British colonial government to keep the Chinese community appeased when the British relinquished their “IRON†hold on Malaysia. I have to admit that this ploy had worked tremendously well over the 50 years of independence. In all this time that MCA had existed, the rights of citizenship of Malaysian Chinese had been trampled on with impunity by UMNO; Malaysian Chinese had no rights of citizenship whatsoever. I want to remind UMNO that Chinese & Indian Malaysians too have RIGHTS OF CITIZENSHIP, which you deny us because Malaysia is GOVERNED BY JUDGES AND NOT GOVERNED BY THE LAW AND CONSTITUTION OF MALAYSIA.

CONGRATULATION DATO SERI ANWAR IBRAHIM ! I WAS HOPING THAT OPPOSITION WILL FORM GOVERNMENT BUT IT WILL BE NEXT TIME; BUT ALL THE SAME YOUR LEADERSHIP HAS IGNITED A WHOLE atomic bomb for the UMNO; forget the MCA MIC and Gerakhan, after such a dramatic loss, they will not exist any longer.
There is no doubt that your coalition will form the one after next government of Malaysia. The greatest of your stunning contribution to Malaysia is your singlehanded destruction of UMNO from a totally impossible position; this also proves that Malaysian politics will not need to be RACE BASED and our people can progress towards a just & equal society. I believe that we Chinese do not object to a just & equal AFFIRMATIVE ACTION that distributes assistance to the disadvantaged to all who need government help to advance (children of the poor)BUT IT NEED NOT BE ALL FOR THE MALAYS ALONE (take much for the Malays but not all). Bear in mind that the cream of Malays can only be picked from all the Malays of the nation and not merely from an elite.
Malaysia needs to return the nation from one that is RULED BY CORRUPT JUDGES TO ONE THAT IS LAW BASED and ruled by law. This is the most urgent need for the nation to recover after the destruction of the independant judicial system. Corrupt Judges usurp the functions of Parliament and hence power of the people. If the present system is not replaced, then there is no need for the existence of Parliament because all laws that are legislated WILL NOT BE ENFORCED. Why have Parliament at all ? The judicial system is fine IF THE LAWS ARE ENFORCED AND TO RETURN THE PRESENT STATE OF CHAOS YOU MERELY NEED TO ENFORCE THE LAWS.
May I suggest that IT WILL BE THE MOST EXPLOSIVE MAIDEN ADDRESS TO PARLIAMENT BY THE LEADER OF THE OPPOSITION IF DATO SERI WILL EXPOSE THE CRIMINAL CONDUCT & BEHAVIOUR OF JUDGE DATO ZAINON BINTI MOHD. ALI OF THE MALAYSIAN COURT OF APPEAL. ALL THE REQUIRED EVIDENCE ARE IN THE COURT FILE OF MY WIFE’S PETITION. There is no other evidence necessary, just what is filed (provided the file is not already destroyed, as I believe it is very likely). Dato Zainon binti Mohd. Ali was utterly criminal and a PUBLIC EXPOSURE OF HER CRIMINAL BEHAVIOUR IN PARLIAMENT WILL PUT MALAYSIA BACK INTO THE STRAIGHT AND NARROW. The Malaysian Constitution in its original form was a document that delivered to the People justice according to law; but after the “513†riots, UMNO had progressively undermined the justice elements of the Constitution to finally make nonsense of the Constitution. The Malaysian Constitution today is nothing short a joke and is the laughing stock of the world community. The final product of all the amendments that have been made to meet the political whims of Tun Mahatir is a document that is meaningless; of all the craziness that went to amend the Constitution are those that GAVE ABSOLUTE POWER TO THE JUDICIARY TO DO & ACT ILLEGALLY AND OUTSIDE THE LAW AS AND WHEN IT PLEASES THEM TO DO SO. Malaysia today is lawless because High Court judges themselves commit criminal offences while performing their duties on the bench because they are not required to be accountable and in their IGNORANCE OF THE LAW they commit breaches of the Penal Code and still are not held accountable. If the laws of the nation is not held sacrosanct as it is not held sacrosanct in Malaysia, then there is no need for the very existence of Parliament, because Judges in Malaysia make their own laws by not strictly enforcing the law. Judges depart from provisions of the law and do as they pleased. What jurisprudence in all the civilized world can make sense of the over-riding of the Malaysian Constitution by the Sharia laws, because the Constitution IS THE MOTHER OF ALL LAWS and the Sharia must come under the Constitution not the other way around; this proposition is so basic that any 1st year law student must know, and yet the Highest Court of Malaysia went on to over ride the Malaysian Constitution by the Sharia.
The sorry state of Malaysian politics has come about because the leaders of MCA & MIC were co-conspirators to the leaders UMNO to commit PLUNDER on the nation’s wealth and resources. Without exception the leaders of UMNO<MIC & MCA all became rich; just handful of super rich and all the others of Malays, Indians and Chinese are no better off than when Malaysia first got independence. The real problem why the Malays have not progressed as far and as fast is because of the myth of the NEP. This New Economic Policy was crafted to weave the illusion that all the benefits of Malay special privileges went to the Malays while the Chinese & Indians do not get to participate in the national largess. The IRONY of propaganda that has been touted by the Barisan National to all Malaysians is that the more that it is said that all the benefits of special privileges goes to the Malays the more the Malay people supports the UMNO; when in truth all the benefits of Special Malay Privileges went to a handful of UMNO leaders and their children, in short to the UMNO elites. I believe that this exclusive group make up of about 5,000 families or at most 6,000 families. The point that I want to emphasize is the UMNO spin that all the special privileges went to the Malays, when in fact that has always been a lie, because ONLY THOSE WHO HAVE PERSONAL CONTACTS WITH UMNO ELITES HAVE ACCESS TO THE GOODIES and the ordinary Malays who may be very qualified will miss out just because they have no one to PULL STRINGS. The creation of this UMNO clique restrict the selection of suitable candidates to only a very narrow and small base and therefore THE BEST & BRIGHTEST OF THE MALAYS ARE NOT GIVEN CHANCES. This process runs through to the whole of everything.
I can speak for the Chinese, when I say that we Chinese do not object to giving special privileges to the Malays, but what is not agreeable to us is that the GOODIES ARE NOT GIVEN OUT TO gain the best returns; instead of culling for the best & brightest from 24 million Malay rakyat, the UMNO dominated system find the required number of candidates from only 5,000 families, therefore how can that be the best & brightest ?
From my perspective, if the Malaysian Constitution were brought back to its original form as when it was originally framed, Malaysia will progress much faster and we in Malaysia will eventually catch up to Singapore instead of looking with envy across the Johore Straits because we in Malaysia do not have a viable and equitable model to develop our nation. We in Malaysia have natural resources while Singapore has only rocks, so why are we still behind in our development ? We had the NEP for the last 40 Years and we have not made any meaningful progress, so why do we not try out something new. If People’s Republic of China can rise in world ranking from 132 to No 2 in just a matter of 20 years, what cannot Malaysia do if we had a model that works instead on that is 40 years old and it does not work !
UMNO cannot be salvaged because UMNO is built on an ethos of HATE, it finds support from the Malays by spreading the myth of the Chinese having it all and the Malays are robbed by the Chinese; this is not true but to the Malays it is comforting to know that it is not their inaptitude or their incompetence that is to blame but it is the Chinese that has deprived them of what is theirs. If the truth be told, the Chinese are the ones who keep the economy afloat, of course the Malays will not admit although they know in their own mind that this is so. Who are the people who handle the trade in Malaysia and who are the entrepreneurs in Malaysia if not for the Chinese. We have not been the recipients of any government hand outs for 50 years and we will not need any in the future either. I really think it is good counsel for the Malays not to loose the Chinese component of Malaysia too quickly or as the saying goes, “you may regret getting what you hope forâ€.
I had earlier written an opinion that for the well being of Malaysia it is not merely enough that UMNO be toppled, BUT UMNO MUST BE DESTROYED and a new and totally Malaysian Malaysia be put in the place of UMNO. I have always advocated that Dato Seri Anwar is the right leader and this point in Malaysian history, because he has the wisdom to state publicly tat the NEP must be scraped and in its place a model that is Dato Seri Anwar’s be put in place. Malaysia has so far only known race based politics and that model is UMNO and it is divisive and from this election the people have rejected it as nt workable. I had also advocated that with the success of the coalition of PAS, DAP and PKR a two party system will emerge, but since the tremendous success of this coalition, my sights have broadened. I believe that it is time for the MCA and the MIC and the PAS and the DAP to merge with PKR to form a non-race based party and that will mean that all these coalition components become as one as eg. Become PKR; remember only a Malay under the Malaysian Constitution can be Prime Minister. However this can only happen in a distant future because PAS will not easily give up their individuality, they may loose support if they did. My suggestion is for a future when our people are more sophisticated.
However, The relevance of MCA and MIC have lost their meaning and there is nothing for MCA to stick around UMNO except to lick UMNO arses. I believe that is not this one the next UMNO will loose government. In its present form MCA cannot represent the Chinese in any meaningful way. Having said that may I tout the idea that all MCA members of Parliament of this election CROSS THE FLOOR OF PARLIAMENT AND JOING IN UNITED FRONT WITH KEADILAN TO FORM GOVERNMENT. MCA must not compound their 50 years of licking the feet of UMNO. Stand up on your “hiny†and bid UMNO farewell. Chinese interests is best served by PKR.

I believe UMNO still has not awakened to the reality that the Malays have rejected their racist brand of nationalism. To be truthful, I myself have not yet come to believe that the Malays have registered their rejection of UMNO. The Malaysian model of race based politics was in fact a powder keg waiting to blow up into a typical guerrilla led insurgency; because the lesson of history is that when people have no means to support their family, they will take the law into their own hands. This is a rule of natural law, as we can all see what is going on in Africa and Latin America. The situation in Malaysia was at the tipping point and just a slight nudge and we will be in the middle of such a debilitating insurgency, that will drain the resources of the nation and turn Malaysia into another basket case.
If we will only find the courage to admit the truth that the NEP had no chance of succeeding; because the NEP was a programme of exclusion; and those who held the power of implementing the policy had a vested interest to keep the benefits of such a crazy scheme to themselves. The Chinese was never at any point to blame for the lack of progress of the Malay race. The blame should sit squarely on the shoulders of UMNO leaders. If those in UMNO who held the power of dispensing government largess had any care to improve the fortunes of the Malays, they should have manage the programme in a more responsible and honest manner, but instead they restricted the benefits to their own small clique; hence government largess were given to only connected families. This restricted the programme to too few candidates and the quality of recipients were very low. Malaysian scholarships went to recipients who chose the easy courses of study that had no practical value in the job market, resulting in a colossal waste of scarce resources and it produced a culture of indifference; and it also produced graduates who could not find jobs and had to be absorbed into government service of pen pushers, a total waste of money.
The election of 2008 is a defining moment. For the first time in 50 years history a crucial section of the Malays had come to realize that change had to come to save Malaysia from UMNO. This turn of events at this moment is a mere illusion because UMNO is still the Federal Government and in the next election UMNO will massively stuff the ballot boxes. If I may say so, the most important institution for a coup d’tat is well placed and entrenched by UMNO judges and my namesis is that fat woman judge Zainon binti Mohd. Ali and from my own experience with Judge Zainon binti Mohd. Ali, either through ignorance of the law or sheer disrespect of the law will dare to decide my wife’s petition in breach of the penal code and hence had herself committed several crimes. This piece of comedy is unprecedented in all of legal history anywhere in the Commonwealth.
This morning I read an article in Malaysians Unplugged on Dato Seri Anwar, and the author raised issues whether Dato Seri is or is not the Anwar of before his incarceration on trumped up criminal charges. I believe this line of enquiry is both futile and irrelevant. We just cannot assess a man’s character under any circumstances. I had some one who I held as a dear friend for over 65 years and I just was unable to know that he was all along one of my worst enemy. However, the point that I want to put across is that in politics and the choice that we ordinary man in the street has to make to vote in a good government does not require that we know Dato Seri or not.; ALL THAT IS REQUIRED OF US IS TO ACCEPT OR DENY WHAT HE SAYS HE WANTS FOR MALAYSIA. If what Dato Seri wants for us is what we as voter wants, then it is Dato Seri who we will vote for as our government. Is Dato Seri a truly a good man ? That question is to me, not relevant. I have never ever met Dato Seri but what he wants for Malaysia is what to my mind what I want and to all Malaysians I can only say that UMNO’s policy of race, with emphasis for Malays as the superior race is WRONG AND WILL BE NON PRODUCTIVE FOR MALAYSIA.
I dare say that our Malaysian founding fathers like the Tengku even as he kicked out Singapore from the Federation realized that what Lee Kuan Yew said made sense and yet he felt that the Malays wanted a race based Malaysia and he acceded to their demands; and now after 50 years of independence both the Tengku and lee Kuan Yew are both right, and to say the least Malaysia took the wrong path. To this point in time (50 bloody years) Malaysia will have a “window of opportunity to get back on the ‘railâ€. Contrary to UMNO’s and the Malays misled by UMNO Malaysia has not progressed at all and if I may say so myself, Malaysia had regressed because Malaysia has a 3rd world education system and Malaysia has descended into a spiral of LAWLESSNESS. You will disagree but ask yourself if you had any laudable achievements in these 50 years ? Singapore had nothing but dirt and of course a predominantly Chinese and Indian population; and they have gone into such tremendous race into the front ranks of developed nations BECAUSE SINGAPORE HAD A MODEL THAT IS INCLUSIVE, NOT EXCLUSIVE.
I had said earlier that after this 2008 election Malaysia merely has a WINDOW FOR CHANGE and we all are hanging our hopes on an Anwar led coalition to bring about change, This change is merely a hope because it can still de-rail. Affirmative action is an illusion that is difficult to wean off and may still return to de-rail our hopes. THE MAIN AND No ! priority is to restore a first world judiciary so that the laws will be respected and strictly enforced. What is the use for the government to legislate when the courts will not respect the laws ? To entrench an ethical, honest and corruption free judiciary, the PKR led government must totally dismantle the UMNO machinery that has been put in place to hold an iron grip on retention of power and government.
My the No. 1 issue in my list of priority is to remove the number of UMNO judges on the bench of the High Court and for that purpose, I recommend my wife’s petition and the abuse of power that was perpetrated by Judge Zainon binti Mohd. Ali will be the first act to restore independence of the judiciary on the saying, “kill a chicken to scare a monkeyâ€.

THE ANWAR LED REVOLUTION IS ONLY TIP OF ICEBERG !
Let me call this Anwar led revolution, at this point the 3 stage revolution because progress in achieving this admirable mission can be measured and seen in concrete terms in 3 stages. The 1st stage of this revolution is to consolidate PAKATAN RAKYAT’S POWER BASE, that is now centered in Penang & Selangor & kelantan because at this stage only the bare ‘form work†has been put in place; the most important being the PAKATAN RAKYAT coalition capturing the government of the 5 states and to put UMNO into a death spiral attracting the disruptive tsunami of Tun Mahatir intent on bringing about an UMNO that is to his liking and of his image. To say the least these two developments are complimentary one with the other, the capture of the 5 state governments will give the PAKATAN RAKYAT coalition the platform to show case their policy that is merit based and to demonstrate that meritocracy will not necessarily disadvantage the Malays; while the destructive force of the Mahatir tsunami will reduce the defense capability of UMNO to counter the onslaught of the PAKATAN RAKYAT coalition.
In the Malaysian media today, there is debate as to whether it is opportune for Pakatan Rakyat to shoot for forming the national government of that they should wait until they become stronger, and most of the opinion is to wait; but to my way of thinking there is no better time than NOW. There is no wisdom for waiting, because you are in politics to wrest government at the earliest time possible. There is never and I mean never any good sense to wait for a better time. Politics is all about the possible and never about CERTAINTY, there is no certainty in politics, GO FOR THE KILL AND DO WHATEVER WILL GIVE YOU THAT OPPORTUNITY.
There are naïve opinions that Pakatan Rakyat should not receive MP crossing the floor of Parliament as if the end purpose of Pakatan Rakyat is to have a puritanical PAKATAN RAKYAT pure as driven snow, but that will be foolishness because the most important objective for Pakatan is to form government, the rest can take care of itself. There is never advantage in opposition.
